Hi,
I needed to ask if it was legal for a CA to write a letter say dated May 5th, in which the letter gives you five days to respond, BUT wait until the afternoon of the 10th to mail it, so that I receive it on the 11th?
I have been paying them, talking with them. I have not shirked my debt. It was never my intention to. I paid off my cap one credit card years ago, it even showed on my credit report as paid off. 73 bucks in interest/late fees was left, that I had NO knowledge of. I would have paid it too! Three years later I get attacked by these guys with a bill of 1246.73! I disputed it with him. He sent me a notice of intent to sue.
My husband is active duty marine corps. If we have ANY legal issues... we are so so so screwed!!!
Right now they say I owe over 500 bucks still... ALL interest and "court costs" which they keep putting on every month even though there is no court action. I owe zero principle at this point. The interest is the law offices.

It is a violation for them to sue you when you have Dved! It sounds like this company took you to the cleaners! If the OC said it was paid, then anything past that is simply BS. Also they can't charge you court costs if there has been no court case!!!!

What this company is doing to you is both immoral and illegal! I think being active duty you have access to special lawyers. You REALLY need to speak to a lawyer!!!!

I can't stress this enough...everything they have done to you is illegal.....giving you 5 days to respond, that completely overshadows your right to a 30 day opportunity to dispute!

The whole thing stinks very bad.
