Can a JDB do this?

Can a JDB fill out a complaint and have you sent a summons and then during the months while all this is going on, continue to add more charges to your debt and actually show that you owe more on your credit report than when they started their lawsuit?


Thanks for the reply! It's just so confusing. At one point the JDB has their address listed and it shows Arizona as their address and my account type as "collection". Then a few months later, same JDB has their address listed as New York and my account type as "open".

It really makes it hard on the consumer to figure out things. Wonder why they are listed in two different states and have my account listed in two different ways or does that even make a difference?

you may also consider suing THEM for FCRA violations...those are up to $1000 EACH. So, if they make one mistake on your credit report, that's $1000. If they make the same mistake on all three of your reports, its $3000......if they make the same mistake on all three reports, and they update it every month for a year, then that's $36,000 thay you can sue them for. Think about it.

Also, they cannot charge interest on any account unless the original contract states that interest will continue to accrue. They cannot make up their own terms, they are required to follow the contract terms on the debt until a judge says otherwise.

Also keep in mind that ANY fees and/or interest MUST be detailed in your contract/agreement and that is perfect grounds for you to demand proof. Is this the one that wouldn't allow you discovery? I'm still floored about that. What sky said is golden...if you have an older report that lists as collections and now the new one that lists as open...it would be hard for them to claim a bona fide error!
