Yes they have to be licensed. If they aren't you still owe the principal, but I doubt they'd take you to court 'cause the judge would simply ask for their business license and throw out the case if they couldn't produce one. They can take other measures to collect on the debt however, and you should pay them.

exactly right in fact a collector or attorney collecting must be licensed or bonded in TX to even attempt collections.that means that they must post a bond of between 5,000.00 to 10,000.00 to attempt to collect.meaning whoever is calling you is breaking the law.another btw.if you DV this place they have 30 days set in stone to validate the debt.if they can't then they are required to cease collections entirely.just some things to ponder.

I could not find anything on the Secretary of STate's website saying that Drake Clarke and Associates out of Buffalo NY was licensed in Texas. Anybody know anything about them?

If you can't find a lawyer ( I am in Texas and there is not one in my area) you can sue in your local JP court....just take copies of the Texas statutes with you to show the judge....my JP judge had NO IDEA about the laws:) But I won. :)

Yesterday they called my daughter's in-laws and told them I had a pending lawsuit and that they should contact me before I have to go to court. . . What scum. They are trying to humiliate me into paying them. How are they getting these contacts???? These people were nowhere on my contact list.

My lawyer in Texas tracked down one of these buffalo ny bottomfeeders and sued them for me because he was able to find a collection bond that was not listed with the secretary of state. He was able to collect money from the bond and I still have a large judgment against the collection agency that will probably never be paid. I also got a call today from a Mrs jones to call her back on 1-877-333-6305 but she was calling from 605-299-1999. She left a case number and said that there was a complaint on me in her office and she needed me to call back with more information pertaining this. I called the number to see what this was about and of course Mrs jones was not available so David Marshall helped me and was super rude wanted my ss# and dob, after I would not release this information he demaned to speak to my boss at work and said that he would be sending the Authorities out to my work to arrest me and was screaming and cussing. I hung up on him and he called back like 7 different times yelling a screaming obscientites at me. I called the FTC and just finished writing a demand letter for them to not have any contact with myself or anyone involved in my life whatsoever. i am sending certified per the FTC. Wow this company really needs to no be in business at all and they should all go to jail!!! How did they get my info anyway? They call my work and cell.

today I got a call from "Check Systems" (spelled "check" not chex) at 716-748-6518 regarding a very important matter. . . anyone ever heard of them?
