Wage Garnishment on Judgement
Date: Mon, 06/28/2010 - 08:15
Hi Everyone,
I have a judgement against me that was issued in January 2010. I had contacted the law office handling the collection as I wanted to make payments. They requested an income statement, which I sent to them promptly. The next thing I know I receive a summons in the mail stating they were garnishing my wages. Okay, so I have to deal with that. The court order for the judgement stated the amount to be 1007.00, and in the order it states plus interest and fees. My employer explained to me what the garnishment amounts would be and when they would end, which was to be last Thursday. Now, my employer comes to me last week and says they sent a letter, stating that they were now garnishing for interest and fees as stated in the judgement. The letter told them to contact them for the amounts or they would be held in contempt. My employer called and the amount is 900.00 in addition to the 1007.00. It seems to me there must be some sort of law on how much interest and or fees can be charged, and it seems odd to me that no amounts were ever sent in writing to my employer. I've just recently found so much information on your site and could have prevented all of this as I think the SOL ran out on this anyhow, but it's too late for that now. I was actually relieved to be getting that paid off, but now with this interest they have added (at the last minute) I am experiencing financial hardship due to the amount they are allowed to garnish.
I live in the state of Maine and can anyone offer up any suggestions or help on how to find out where they came up with this amount and is it legal?
Thank you so much.
Feeling overwhelmed.
