You most certainly can! And since you live in a one party state, you don't even have to tell them that you are recording them.
Or if you want to just get them to hopefully get the message and quit calling without actually suing them - tell them up front that you are recording them. Then tell them that they are calling the wrong place and they've been told that before and you intend to file a complaint with your state attorney general and the FTC and that you don't want them calling anymore and if they do, you'll take them to court! Then follow through with calling your State Attorney General's office and the Federal Trade Commission and file a complaint at both places.
Then, see if things don't quiet down! :D

BTW, here's your State Attorney's link - you can even file the complaint online or there is a phone number listed as well. http://www.ag.ny.gov/bureaus/consumer_frauds/filing_a_consumer_complaint.html
And here's a link for the FTC - you can also file a complaint online.

Just so you know, the law states that you must notify them in writing that they are not to call you anymore. EVen getting it on tape does not exactly fit the letter of the law. I would send them a certified letter explaining to them that they are looking for someone that does not live at this address, and that they are to immediately cease all communication with you. That way, if the calls continue, you will have proof from the post office that they received your notice, and then you can take them to court, and so on.....
