Bank Garnish

My daughter lives in Virginia and pulled up her bank account today and noticed her bank account was garnished. About three years ago her boyfriend added her to an apartment lease because he stated the apartment required her name to be added since she was visiting him over 50% of the time. When he failed to pay the rent, the apartment terminated his lease. About 8 months later my daughter received a notice from the apartment that she owed $900 for unpaid rent. She never received a summons for the bank garnishment and so far they have taken about $1300 from her account. Her exboyfriend stated that he received a judgement of $1,200 and did not understand why they were garnishing her bank account. Obviously, he did not pay the judgement so they are now going after her. Can she stop the hold on her account and can they go after her wages?


They must have obtained a judgment against your daughter as well. Your daughter can appeal to the court to set aside the judgment in that case. If they have obtained judgment against your daughter, then they can go after her wages.
