garnishment (income tax refund/credit)

I just received a “request & writ for garnishment (income tax refund/credit)”, so I have been looking around online to is if there is any way not to have our tax refund taken. I currently do not work but did have unemployment income for 2011. My husband & I have always filed our taxes joint. I know that at some point I will have to pay for these judgments, but right now we could use the money. Since our taxes are done by me (I just use Turbo Tax) & if the refund goes into a bank account that is only in my husband’s name will that keep our refund safe from this garnishment since the judgment is only in my name?
