I have been receiving phone calls since June 2010 saying that I owe for a bad check at a check cashing place. The first person I talked to demanded that I pay over the at that moment. THe second, well I didn't talk to her. The third person was a very rude man. Everyone is saying I owe for a check written by someone else on an account at a bank that I have never stepped foot in. The people I did talk to asked me to verify my address and SS#. Tonight the man gave me the last four digits of a SS# that wasn't mine. Now they are telling me that I will be served with papers to go to court. My question is can I sue for harassment? Or, is there something else I can do? To me is sounds like a scam but if not it is a case of mistaken identity. :confused:


OK, so wait a minute...

Youre telling us that this debt collector gave you information about someone else's debt without verifying that they were speaking to the right person? Are you also saying that you have informed them that the SSN they have isnt yours and they STILL demand payment from you anyways?

If I were you, I would go to www.naca.net and pick a consumer attorney in your area. Yes, they have most definitely harassed you, but they have also continued to threaten action against you even after being told that they have the wrong person. On top of it all, they have also violated the FDCPA's third party disclosure statute. Many of the attorneys at that website offer free initial consultations, and also, many will take a case like this on contingency which means you dont have to pay your legal fees. In other words, it wont cost you and you then get to sue these morons for $1000 plus court costs and attorney fees. I would definitely take that--its free money. If they are too ignorant to follow the law, then make them pay. Maybe they will start to learn when it begins to cost them.
