I know this is a bit of a grey area but thought I would ask for input. I sent Weltman, Weinberg & Reis a DV request on an alleged debt for their client LVNV.

They sent me back a copy of a single monthly statement for an old Sears card issued by Citibank. That would seem to cover the request for the original creditor information but not payment history so I can verify what they say I owe is correct, evidence WWR is assigned the debt or original contract.

Should I sent other DV asking for the missing information?

well one question.is the statement recent,or kind of old?i can procure real old statements, but if they are the most recent from this card(which i doubt)then i would count that as valdidation.again though knowing this JDB octopus that is LVNV i'm guessing the statement is old therefore i wouldn't accept it.re-send your DV letter with the re-request for further info.

What do they have to provide that they or LVNV owns the debt? In other words how do I know that they didn't just get my credit report see a delinquent account and contact me trying to collect? Also, what do they need to provide, if anything, to explain what they say I owe if a payment history from the original creditor is not needed? I would think they would have to provide some information at least from the point they owned the account?

The statement is from Dec '08 and is probably one of the last ones generated on the account by the OC.

What about the original contract or credit card application? Do they need to provide that under the FDCPA?
