Should a "law firm" be licensed as a collection agency?

The "law firm" of Weltman, Weinberg & Reis is attempting to collect a debt for LVNV. When I search my state (MN) database for collection agency license info they do not show up.

Should an out of state company that is supposedly a law firm need a license as a debt collector or are there different requirements if they consider themselves to be a law firm and not strictly a collection agency?


In my state, Maine,

A lawyer that is licensed in Maine to practice law, when acting as a debt collector for another firm, does not have to be licensed as a debt collector or collection agency.

If the lawyer is not licensed to practice law in Maine, then they must apply for a licence in Maine.

Maine law seems pretty clear on this.

I do not know if this is common law in other states, but paulcahill80's reply above does seem to confirm that this might be pretty standard.

To me, this looks like a real loophole in the fair credit laws.

If they don't have to be licensed, then there is no license to revoke...

Where is the penalty for nasty behavior?
