sol for defense

I was just served by a collection agency with a summons and complaint. I looked up the summons at the courthouse:?: to see that it was originally filed October 2010. My state's sol is 36 months, the 36th month was November 2010. I just received the Summons on 2/11/201. Can I still use the sol as a defense? Also the name of the original creditor is wrong, so I will deny the debt all together and will only use the SOL if push comes to shove.

If the SOL is already over, then the collection agency will not be able to file a lawsuit against you. If the original creditor's name is wrong in the Summons, then you can deny the debt altogether. Nevertheless, it will be better if you could contact an attorney and take his opinion in this matter.
