My account was sold before payoff, now Kramer collecting on behalf

Long story "shortened"

I received court summons 2 yrs ago for Capitol One debt. Settled with Gamache and Myers to make payments of $100/month until the $1132.00 debt was fulfilled.

Paid $700.00 dollars of the amount, got laid off but stayed in contact with Gamache on a monthly basis. 4 months passed, found a job, went to resume payments and was told by Gamache that my account had been sold off to "another" collections firm. This was in June of 2010.

Made numerous attempts to track down the owners of my account to get it resolved. Eventually got in touch with someone at Gamache and Myers who told me that Kramer and Frank had the account, and they did not have a number I could call them at. Kept trying to contact someone at Kramer and Frank, no return correspondence whatsoever.

Received a letter from the District Court of Johnson County, Kansas stating that "Judgement Creditor's Notice to Judgement Debtor of Filing of Foreign Judgement."
What??
Basically states that I now owe court costs, attorneys fees, and interest, less the $700 credit of which I already paid, for a total of $1090.47.

I contacted Gamache and Myers and aske them why I wasn't notified that my account was sold, they said it wasn't their problem.

I am desperate for help here. I feel that I was diligent for my part of fulfilling my responsibility to pay this off, and now I'm getting forced into paying more money.

What can I do? No response from Kramer and Frank, AT ALL.


If you stopped making payments the firm that had your debt can sell it to whomever they wish. Unfortunately the reason you stopped has nothing to do with it. What state do you live in? Is Kansas where you live or where the collector is located. It sounds like they got a judgement in an improper venue. You really need to get legal counsel if you can afford it. Better to pay your own lawyer then theirs.

Yup,you made an agreement to settle....was this done thru the court? Sounds like a contingency judgment. For what reason, the agreement was not completed and they are coming after you for the entire balance. Pretty standard.

I would hazzard to guess that since this is a Cap One judmgne account, they still own it. You probably could have called Cap One to find out who the account was assigned too.
