I sent a DV letter to Academy collections in October and now I have received a letter from an attorney's office. This letter is similar to a CA's letter and says I have the right to validate. Do I? Academy never validated the debt.

Geberally, according to the fdcpa a collector can choose even not to respond at all, as long as collection has ceased. But, according to some states' law, they indeed have a time frame (usually 30 days) to make some sort of response.

Thanks for the information, LawStudent. I'd been laboring along under the impression that the 30-day time frame for validation was a provision of fdcpa or similar federal law.
MILIO - Regardless of what I just wrote to LawStudent, stand your ground against the collection agency. Send them the DV letter. [Guest, send one to the shyster lawyer, too!] And don't give'em one thin dime until they produce the requested validation. This is not a stalling tactic or evasive maneuver. It's an exercise of your rights under the law.

Those sort of laws are usually located in your state's Finance Code under sections dealing with debtor/creditors. You might google your state with the tag "finance code". I don't know about NY either, but hockeyman would, if he sees this thread. States which I know have these sort of laws (giving the time limit to respond) are Texas and maybe Florida.
