i had a judgement placed against me a 5 months ago and have been making payments to the attorney. last week i tried to change my due date to the 30th instead of the 15th because my payroll changed my paydates. so i called the attorney to see if i could change it and he said no. so i went and filed a slow pay motion and he declined that also so now there is a court date for this wed. what can i expect when i go to court and do i need an attorney to go with me. i am in TN


I wouldn't worry about an attorney, Just go to court and tell the judge that you tried to work out a new payment date with this slimeball (Don't call him that in court) and he refused to work with you. That way you are showing that you still want to make the payments but need to make them one pay date later. The judge should look at the slimeball and ask if this is true, he will probably lie and say no, but the judge will then allow you to use the new date for payments.
Just remember one thing while you are in court. Do not let them intimidate you.

thank you. i figured they would try to intimidate me. i am just hoping that the judge will say ok to the slow pay and lower the payment to what i asked for and change the due date. i thought it was weird that the attorney said no. i am guessing that i have to pay the attorney more fees. or is he not allowed to charge anything else than what he has already charged.
