Does a CA have to send you a letter regarding your debt before listing on CR?

My account with TWC (Time Warner Cable) went in the hole about seven months ago. I received my last bill from them in September for $1376.73 -- $422.61 balance, $953.58 in unreturned equipment. I checked my credit report with TransUnion a few days ago and Time Warner placed me with "CBA" for $597 reported to my CR on 2/08/2011.

1. Why $597? Fine it's a helluva lot better than $1K+
2. Why did I not receive a letter from CBA notifying me of this debt and their intent to place me with collections. I have always received notification of my 3 debts (4 total).

And yes, I am returning the equipment today, and yes I will be getting the receipt!


There is no requirement that a debt collector notify you of their collection activities before reporting to a CRA.
Howver, the posting to your CR consitututes an "initial communication with the consumer" that then triggers the requirement of FDCPA 809(a) for them to send you a collection (dunning) notice within 5-days thereafter.
