1. Loan company: Cashnet USA
2. Loan amount $225.00
3. Already made payments on this (the loan is rather old, 2 years, and my bank account has since closed. I don't know if I have this information readily available).
4. Took out the loan in PA, but now residing in CT.

So I get a call from "Janet" at Tyler & Morgan about a payday loan from CashnetUSA that I took out several years ago. I made payments bi-weekly to certainly cover the the loan amount, but there's they always say that payments I was making were simply the "interest" on the loan.

My bank account has since been closed and my father was contacted by someone at Tyler & Morgan about 6 months ago. He called me, I called T&M and asked them to remove my parents number from their list. I also asked for them to send me some information validating the debt to my address on record. Never received a thing.

I received a phone call today on my cell phone (I don't know how they got that), and I was told I spoke with someone in July. Funny, I must have been really drunk the day I spoke to them because I don't remember speaking with anyone.

I also requested they send me an account history, to which the woman today said she couldn't do that, and they don't have to because they have an agreement with me and that's all they need.

I asked for them to resend a letter they allegedly sent on July 4, to which the woman replied, "Well if you didn't get it the first time, how do you know you'll get it now?" I replied simply, "Well, if you refuse to send me the letter, how can I get this resolved?" I gave her a fax number to send it to. It's been 30 minutes since we disconnected our call, and she told me she'd send it "as soon as we were disconnected". Apparently we live in different measurements of time. She also never noted the call was recorded until I inquired as to whether or not the call was recorded. Isn't it a law that they have to say that?

As soon as I get this letter over the fax, I'll be sending them a letter requesting that they discontinue phone calls to any numbers they have on file, and to send me a history of my account with Cashnet USA (which they said they cannot provide me, but I feel entitled to).

I know this question has been asked 1,000,000 times in this forum, but what else can I do on my end to get these guys off my back? Obviously I have to do some reserach on my end and get my records, as I have my e-mails to and from them from back in 2006. I know I made payments via Western Union and through my bank account. So I'm not sure exactly what else they could be looking for at this point.

Also, has anyone dealt with them in the past? Any suggestions?

I had set up an automatic pay for $100.00 per month.
One month had no record of the payment. 2 months later
I paid $100.00 then payments stopped? So now September 08
there calling me and asking what I am gonna do. I have no
paper work for this transaction, I dont know where I stand
or whats going on, like you when they send me some paper work we'll see.

Hey. I got a call from Tyler and morgan. They said that I have an account with cashnet usa for $150 that I took out 2 years ago. They threatened me that i needed to take care of this because it is the last resort or they will take me to court. They are in florida i live in hawaii. are they a law firm and can they take me to court for $ 150. please help

I received a call just this morning.A Mr.Marino represented himself as a lawyer and threatened to take legal action.During the call I told him I was on their do not call list.He informed me that it had went past that stage.I did get slightly smart.I told him the original creditor CITI (had just received money from the goverment to pay off my debt.)Which I do not owe.LOL.Anyway he also said he had talked with my daughter.She denies this.She was executer of her dads will whom passed away Jan 2006.He said he could continue to call.I told him fine with me.He also got mine and daughters cell phones somehow.I told him to have a nice to and hung up.
The more I thought about it.I realized he was trying to con me so I called back.They answered Tyler and Morgan.I asked the lady if they were a law firm.She hesitated because my number had showed up.She called me by name and said they handled a lot of differant issues.I again asked if this was a law firm.She said I would have to talk with someone else in the legal department she was just a receptionist.I was transferred to another lady.I asked her the same question and also told her about talking with someone whom represented themself as a lawer.NO ANSWER I would have to talk with MR.Marino.
I was transferred to Mr.Marino.
I asked Mr.Marino if he was a lawyer.Hesitation..He said he had never said he was a lawyer.I informed him that he had told me he was with Tyler and Morgan and they were going to start action.Again he denied it.I asked him again What law firm do you use to persue legal actions? Is it Tyler And Morgan.
Mr.Morgan responded:I can not talk with you because you asked not to be called anymore.A few minutes previous I had been told they could call anytime.I told him I was going to contact My Attorney General and have blessed day and hung up.

They are Junk Debt Buyers (JDB's), not attornies. That does not preclude them retaining an attorney in your area to file suit. Not a lot on them on Bud's site though:

I do see a few suits tht were recently filed against them on Justia (the judge for one is being sued for s e x ual harrassment :evil: )and some posts on various forums. Looks like they're fairly new to the game but are fitting right in with the usual suspects :evil:

T&M called me about an account I had with a bank 6years ago. They said they had permission to settle with me for aprox. $1600, made in two payments. I told them I would pay the first half but that I wanted the history of my account, because I didnt think I owed that much, before I payed the second half. They agreed. I never recieved any information and didn't hear back from them for 5 months. reciently I recieved a call from them saying they had started court proceedings and that I had to settle now. I called them back and told them I had never recieved the paper work. Now I was told that they couldn't provide that info. I told them if they couldnt keep up with thier end of the deal nither would I.
I told them to call thier lawyer and I would call mine. Then they told me if I didnt pay the second half today I would loose the previous $800+ I had already payed. When asked why it hadnt been payed toward my debt they said that they kept it until they had the full amount. Can they do that? I have bank records showing that I payed them the money. Can they take money from someone for a debt then keep it?
DON"T GIVE THEM MONEY!!

I received a call from T&M, about a loan with cash net for 256.04, the lady said I had to pay 128.02 right then and she could take the other half in dec.the payment was scheduled to come out on the 19th, but did not. She also lied about being with an attorneys office, she said if I did not pay the 128.02 then they would file charges on me, I am so tired of these people.

NOOOOOO They can't keep it. As a matter of fact, screw them. The person you talked to is not a lawyer, correct? They are using extortion to get you to pay. If I where you I would call an attorney and thell them what happened. If you don't have one go to NACA.net and look for a fdcpa and FCRA attorney in your area.

I get calls from these guys approximately 6 times/day (my parents get them too) but I always let it go to voice mail (I never answer the phone unless I recognize the number or its a VIP ring from my call intercept), they always call me by my maiden name and threaten legal action but never mention what for and they say that they are pursuing action in a county and state I know longer reside in.....these guys are idiots and I would never call back and speak to them never mind Pay them a cent. IMO they need to find a real job and get some morals....this is not the time to be doing this to people. It is too difficult making ends meet without bringing back past debts that are well beyond the 7 year statute for collection....I have been married going on 10 years so obviously the debt they want me for is really old and probably already paid years before that!!!!!

i too have been getting calls and they won't give me anything in writing and claim i owe a $295 debt to a company i've never heard of much less owe. I lodged a formal complaint with the FTC and the Attorney General's office. What they are doing is highly illegal and if you go to the Clerk of Courts for Hillsborough county FL they have a lawsuit pending from July where it appears that they refused the summons and didn't show up to court. They are not attorneys and a questionable debt collections. Please lodge a complaint against them to those two agencies and help shut them down!

I never heard of T&M befor last week .They have been calling my
office over and over and over. I have never heard of the person they are looking for and when I have asked them to stop calling they say this is the guys number.How many people have an 800 number for a home number.This guy told me to shut and that I had better listen to him. I truly thought he was talking to a co-woker not to me.I made a call to the presidents office and asked again to be taken off the list .I was told that it would happen.Guess what the same guy called my secretary and asked to speak to her supervisor.This clown tried to report me to me.I have now filed a complaint. lets see what happens.

Only 3 people have ever sued them for FDCPA violations. There are only 4 complaints against them with the BBB, since they opened in Oct 2007.

According to the FTC, they cannot call you at work if you tell them that you cannot receive calls at work. You do not have to write them, only tell them. Otherwise, sue them. They will continue to break the law if they can get away with it. And if no one sues them it means they *are* getting away with it, if this is a regular practice with them.

File a complaint with the FTC, the BBB, the FCC, and your State Attorney General's Office.
