Arrest threatening call from United Processing

About 30 minutes ago, I received a threatening phone call from United Processing out of Jacksonville, FL. They said they have a court case filed with my county's DA office about a bad check I wrote to Cash N Go for $400 dollars back in May. They are asking $1050 to terminate this case. They gave me only 1 hour to pay back the full amount thru MoneyGram. Cash N Go is a local storefront who actually filed a civil case for $550 of which I did not contest. They said someone from the Sheriff's department will be coming to my home or work to either arrest me or more paperwork. Has anyone been arrested for this scenario? What should I do? I am now very worried.

the postings on smith dean and associates is hilarious......my encounter w them came about a couple of months ago when i met w there sales rep mike gaggis , who look like he popped more pills than heath ledger on the day he died, tried to solicit my company business , the office looked like a broke down version of sanford and son house on a bad day , i knew when i walked in that company would not get my business, then the kicker came when the OWNER LISA SMITH walked in looking like she walked off phillips hwy after a night of tricks, she sounded like a hillibilly trying to sound articulate, imagine the sound of that , it took everything for me not to run out of there ....so when i read these postings i am not surprised i heard alot about her, even the company i eventually went with know of her and her shady business practices and living above her means and robbing peter to pay paul and owing everybody .......this company is SHADY AS THEY COME i give them another 6 mos if that ......BEWARE AND STAY CLEAR!!!!!

i recieved a message from jason smith stating i need to call his office immediately he was an investgator and calling regarding a felony check.....i returned the call he stated that i needed to pay this by 8pm tonight via $$$$$gram or i was going to jail, i asked was he the police he stated he was a investigator, i started to become suspicious due to the fact he sound like he could be my 10 yr old brother using words to big for his vocabulary ....he stated again if i didnt pay i was going to jail, i told my mother who happens to work for an attorney and she stated its illegal.....dont deal w this crooks , is the economy that bad where there trying to take my peanuts??????

I was recentl contacted by several different representatives from Smith, Dean & Associates.
I was read NO mini-miranda, first of all. I used to be a collector, and though that statement is lame, it is mandatory that any agency attempting to collect a debt recite it to you before beginning any discussion involving outstanding debts.
Second, I inquired about the balance in question. I was faxed a copy of the original bill, directly from the original creditor's office. It was a legitimate bill, and it was simply overlooked. I never intended to bail out on a bill, or "run away from my debts because I'm a criminal".
I was told that if I did not pay the balance in full ($187) by 1pm that day, that they would be forced to file a claim against me and garnish my wages.
In a later conversation (same day), I was told that I had to pay the balance by 12pm. For some reason, this time continued to change with each subsequent phone conversation. Probably because they cannot legally do anything to me, besides report the balance as unpaid to credit reporting agencies.
I asked all of the reps that I spoke with if they were a collection agency. I was told that they were a law office, not a collection agency. I do not feel that is the truth, as I could not find any lawyers listed as representing Smith, Dean & Associates on the Florida Bar website.
While speaking with Mr. Davis on the phone, he transferred me to an "account closer", which is basically someone who further brow-beats you, trying to get you so scared that you'll do anything to pay the account, ASAP.
She informed me that she needs new inform ation from me, such as my home address and home telephone number, in order to process the claim to garnish my wages. I cooperated with her and gave her my home address and telephone number. There isn't much they can do with it.
Unless this company has bought the debt outright (please correct me if I am wrong), they cannot garnish my wages. Only the original creditor can garnish my wages.
Do not fall for these scare tactics. Smith, Dean & Associates are bullies, at best.
I was also told many times by both representatives that a Jacksonville Sheriff's Officer was going to come to my home or place of business to serve me with claim papers to have my wages garnished.
Really? You'd think our law enforcement officers had better things to do than drive around serving people with wage-garnishment notices all day.
The best thing you can do is know your rights, be polite and cooperative (unless you are uncomfortable or feel you are being harassed) and stay calm.
If you feel you are being harassed, or if a collection agency has broken any laws that you are aware of (for heaven's sake, do your home work and nail them for EVERY law they break), contact the Federal Trade Commission, your local government, and the BBB. Don't give up!
If enough people complain through the proper channels about these unethical companies, the government will put them in their places.
Smith, Dean & Associates has already been sued by the State of Illinois, and I believe several other states.

I am filing a class action lawsuit against Smith, Dean & Associates. They barked up the wrong tree when they thought they were going to use illegal tactics to scare me into paying a bill, no matter the validity.
The point is not about the bill. The point is that they are breaking a lot of laws, lying, and brow-beating people into terms and conditions they are not comfortable with. Basically, that's harassment.
Unfortunately for them, I have a LOT of time on my hands to do research and proceed with the process of trying to shut their business down.

Yesterday I got a message on my phone from a Jason James saying I was in fraud of a bad check. My husband called him back and Mr. James said that a sheriff from Holmes County, Florida was dispatched to my house to pick me up for fraud.
We had just made a payment to the company we owed and had just talked to them moments before inquiring about my balance.
So it was a shock to get this phone call. I am in bad health and my husband tried to reason with Mr. James and tried to ask if arrangements could be made to make "MY" payment of $295.00 to them on Friday of that week. Mr. James refused and said to keep the money because my bail was really high and I wouldn't see a judge for 2 weeks because of fraud charges.
He said I'd be liable for court cost and attorney fees. He told my husband to get a Money-Gram sent off to Wal-Mart within the two hour limit because he had a court case he had to be at in that time frame.
After hanging up with Mr. James, my husband called back the company we owed the money to and asked about this, they said they had no idea where it was coming out of. See Smith and Dean gave my husband information on where to send the money and it was going to Jacksonville, FL. Which according to the manager of the loan company we were dealing with said they were not out of Jacksonville, but Quincy,FL.
During the time my husband was talking to the manager, this Mr. James was calling my parents 6 hrs. away from me and telling them that I was going to jail for fraud and bad checks... for one, I don't have "checks" I have a loan... and Mr.James told them it was for $400. which it isn't. Scaring my mom, she said she would pay it, just tell her where, and when he gave the same song and dance to her about Wal-Mart and getting it to him quick she backed off and said, "I'll wait to hear from my son-in-law first." Upon which time, he hung up on my mom.
We have gotten 3 other calls from these people, two from Mr. Jason James and one from Angie Smith, all saying they're going to take me to jail. I have gone to the Internet looking them up and found them to be nasty people, using unethical practice, rude, and under minding the American people. I told the manager of the loan company how these people were and she acted like she could care less. Guess it runs in the system.
One thing for sure. I'm paying this as I can, and as long as I make my payment there's nothing they can do to hurt me.

You Smith Dean and Unprofessionals... are a bunch of LIARS! My company did what we call a "Mystery Shopper". We wanted to see what we would be getting ourselves into before we hired you and I'm so glad we didn't. Our fake debtor was talked to in a very unprofessional way and was at one time cursed at. You cannot lie to people about who you are and tell them they are going to jail. You told our fake debtor that you were with the State Atty. Gen. office and you were sending the police to his place of employment to lock him up. That's not how my company operates and I do not want to be affiliated with a company who takes actions as such. I tested another company and they passed with flying color. They were very professional and not threatening. They talked in clear voices not in ebonics. They made fair arrangements with the fake debtor. You all could take a few lessons from this company and have some class about yourselves. I hired them and have had 75% pay back.

They made the same threats etc! Threatened to have people arrested and so forth....some debt collectors in Buffalo...the police showed up and arrested the owner, the place is closed down and I believe the owner and some or the former employees are in legal hot water!! These people sound as if they are going down the same road, it's only a matter of time. Illinois state attorney general filed a restraining order I believe against them earlier in the yr. Also, the feds have also been alerted about these folks. Only a matter of time....

As all of you have read in the previous posts.Do not fall for these tactics.My mil received a call from DEAN & ASSOCIATES.They proceeded in telling her all our business.Eventually getting a cell phone # & phoning my husband at work.He in turn got upset, to say the least.He called me at work insisting I go imediatily go to Walmart and purchase a money-gram, for debt amount.Send it to a Jacksonville address within the hour;or my husband would be picked up by law enforcement and jailed.If it wasn't for the web I would have done just that.It would have wiped out my bank account.Leaving me nothing,for even necessites such as bread. Today I received multiple phone calls from Lisa Sanchez of Dean and Associates threatening that I had a felony on me and that the Sheriff's office would pick me up for writing a bad check. She called over ten times to my place of employment, even after she was told that I could not accept personal phone calls at my job and not to call back. She asked me if I thought I could get away with writing a bad check and that I would be prosecuted. I told her she was violating the Fair Debt Collections Act and she said she didn't care and proceeded to tell me that I had committed a crime and would be picked up. She then called back and asked for my supervisor. I told her no that also was again that she was violating the Fair Debt Act and she continued to call back, at least ten times total within five minutes. She must have called one of our other offices and asked for my supervisor's name so then she called back and asked for my supervisor's name specifically and again I would not let her get through. I called my attorney and he told me next time she called to let her talk to my supervisor and to let her "knock her socks off" because she was in direct violation many times of the Fair Debt Act and that all she was doing is building up our witness list. This company must have all kinds of lawsuits pending and will have another one started on Tuesday. They do not respect laws at all. Pyday loans are a civil matter and not criminal.

You can contact a civil attorney and get them off your back but this is a civil matter only. They are trying that with me and they cannot file a criminal suit. The check is a promissory note only and this is a civil matter. You can file a complaint with the State Attorneys Office and Office of Consumer Affairs. Any threats of a criminal lawsuit are against the Fair Debt and Collections Practices Act and you can get a lawyer.

I'm no lawyer, but I am very savvy with a computer and internet access. I've had problems with collectors like this before so I familiarized myself with the Fair Debt Collection practices. A few things to remember:
1. Tell the caller that you would not like to be contacted further by phone. Any contact beyond this point should be by mail. They should have the address since they are threatening to send police to your home.
2. Let them know that this is your formal request to stop calling you, your job or anyone loosely related to you. Also ask if they need that request in writing; if so, please provide their address.
3. Tell them plainly that you consider this harassment and you will be reporting them to your state's attorney's office and the FTC. You can also let them know that if they are reputable, this conversation is being recorded and will by law constitute a formal request.
NOTE: Even if they yell, curse or threaten, continue to speak in a calm and professional manner and say all of the key phrases above.
They should not call back.

My brother recieved a phone call yesterday from these people saying he has 30 min to get $400 into them or he was going to jail. My brother being mentally handicapped lost it. He was an emotional wreck!!! I got involved because my brother was not in any way shape or form able to talk to these people and did not have any way of getting them the money.
Verbatum: "Get us the money or you are royally fuc*ed my friend" is exactly what he told me regarding my brother.
This goes on for about 3 hours....
In the end, and being a law student, wanted some very simple questions answered all I got was "Leave me the f**K alone and hung up on"

Fortunately I previously owned a business and I knoew there were certain guidelines in place for collecting on a "bad check". I called the county attorney and she confirmed what I thought. I decided to do more research online and discovered this site. Now I cannot wait to speak to them again. This has provided me with exactly what I need to call their bluff and begin documenting their harrassment for my records in case I decide to file a case against them. Thanks!

If you go to one of the CheckNGo offices you'll see theres a notice on the wall saying that acording to law that type of company is not allowed to file "bad check" charges against their customers. They can collect, but not file any types of charges and have you "picked up". What they're doing is 100% illegal. If you actually have a judgment against you (from an actual court of law), of course you should pay it. The next thing they would do is attach wages. But you also may be "judgement-proof" if you have no property they can seize and if your income is so low that they can't attach wages. Then there's nothing at all they can do to you.

By law you have to inform them that you are recording them for records purpose. Most time they will not be stupid enough to break the law after that but other times they have been know to still break the law. As soon as they do you've got them. MAKE SURE YOU INFORM THEM THAT YOU ARE RECORDING THEIR CALL!!

actually some states are one party.that means only one party needs to know that the calls is being recorded.please check your state laws on this.i think alot of bottomfeeders are aware of this.if you are in a one party state,record away.in a two party state you must inform the collector.

I have contacted FTC, the Florida Attorney General and the Office of Financial Regulation of Florida. You MUST pursue this! Continue filing complaints until this scam circle is shut down. I can't believe that the FTC and AG here in Florida continue to let this go on after so many complaints. As of this morning, the AG had 24 complaints against the. The BBB gives them a grade of F. They need to be stopped!!!

I received messages on my voicemail on the hour every hour, after speaking with them and clearly stating that I would get back to them regarding the matter at hand. They pretend to be federal investigaters, and make false accusation and claims that are false.

You can place a VOIP Skype call to 800 numbers for free or regular numbers for a small charge. Magic Jack will cost you around 20 bucks a year plus $40 bucks for the equipment for unlimited calling. SO, I got this phone call today from Angela Smith - just like all of you I'm going to jail tonight. This is absurd. When I tried to find out more information, like my case number ETC, they got flustered and hung up on me. So I called back again.. basically I was hung up on 4 times. I left work 5 hours early to move money around so I wouldn't go to jail ... I'm really glad as I was in line my friend called me and told me about all of this stuff online. I contacted Loansmart myself, and although they have recently sold their old debts to these jerks, they do not condone their behavior and you ARE ABLE to pay directly at the institution you borrowed from. I told them I had every intention of paying, but I dont respond kindly to threats. I have a young child and how dare you scare me into thinking you're going to take me away from him for $379. I'm also on hold with the attorney general's office, maybe Ohio can get them on a restraining order just like Illinois.

A friend got a couple of messages from these fools, was worried and didn't know what to do. He talked to me about his options and I knew he couldn't be arrested or anything like they threaten. I was able to calm him down and set things straight. Last month they called on a Sunday while at his place helping him out with his car so I answered. Oh what a blast that was!
Immediatly I was told that if I don't pay $450 the sheriff would be over to arrest me and kick me out of the house. That was their first statement! They didn't ask who they were speaking to. So in my sobbiest voice, totally scared I begged "NO, PLEASE DON'T DO THAT, I WILL DO ANYTHING" and again the guy demanded money right now. I totally changed my voice and in a very calm voice I said "Pay you right now? Oh I can't do that." So the idiot yelled at me then I am going to have you arrested! "NOOOO, PLEASE OH PLEASE DON'T HAVE ME ARRESTED!" silence for just a second (I sobbed) and he said then are you ready to pay your bill? Calmly again I say "Pay right now? Oh heavens no I won't pay right now." This is where I could sence the total rage consuming this idiot and he exploded with "THAT IS IT YOU ARE GOING TO JAIL FOR A LONG TIME AND I WILL SEE TO IT THAT THE SHERIFF TAKES EVERYTHING YOU HAVE HAS YOU FIRED FROM YOUR JOB! YOU WILL REGRET THE DAY YOU MESSED WITH ME! YOU ARE GOING TO JAIL AND THAT IS THAT!" So I say.... "OK OK OK, you got me, I am sorry. Please, please work with me I want to make good. I'll do whatever it takes. I'll call my parents, I'll ask my friends please don't send me to jail." Idiot... "THEN PAY YOUR F*CKING G-D BILL RIGHT NOW!" and of course I calmly respond "Anything but that, I can't do that."
Click... my friend laughs about how he hasn't had a call since from them... He made a mistake. Got in over his head. He has the responsiblity to pay his obligations but *NOBODY* deserve's to be treated this way.

I had the same going to take you to jail with a Miss Smith from this company, that their rep was at courthouse at that very minute filing charges and I would a warrant would be issued for me for class 3 Felony. Sadly I had called them back when they first called and was willing to pay it off right now, but after that avuse I said screw it. I will contact original debtor and pay them directly.

I just spoke with an Attorney, Jeremy from Bromagen and Rathet Law Firm. He will help. From what I understand lawsuits have already been filed against Smith, Dean and Associates. He will take my case as well. I pay nothing as Smith, Dean will be required to pay all attorney fees. I suggest you take the time to call. This company needs to be stopped.
