Cach LLC, Scott Lowery, and unraveling the riddle
Date: Tue, 12/13/2011 - 13:37
Hi all.
Getting sued by Cach LLC. Won a transfer of venue, and they have started action in the new county.
Thus, continuing to investigate.
Good news/bad news.
The good news:
Scott Lowery is the CEO of Collect America. Collect America is the registered agent for the Cach LLC corporation.
By california law, it is a misdemeanor for an attorney to 'directly or indirectly buy or be interested in buying any evidence of debt or thing in action with intent to bring suit thereon'.
The Bad News:
Maybe not bad, but I don't know the answer to this question. If Scott Lowery is an attorney directly involved in buying bad debt with intent to collect, which is a misdemeanor in california, if he is doing that from Colorado -in- California, is he under California jurisdiction?
Also, (potentially good news) Cach LLC (a Colorado corporatoin) is not registered with the California Secretary of State, but the state rules say that it should be since it regularly conducts business transactions in the state (hiring different lawyers, etc)
Curious for your feedback on the topic.

Or not
Spoke too soon.
Lowery sold Collect America.
Now as far as I can tell he is just involved in his law office that collects on debt. But he's also the head of Square Two. Not sure how that fits in yet.
So the original post still applies, except he's not the head of CACV anymore.
