Strange question but, I have had a CA calling me (about a cap 1 cc) work, cell and leaving me messages to return there calls for the past six or eight weeks. I have not answered or returned a call yet. I received my first and only ( so far) letter from them about three weeks ago. I have not responded to them yet, but for some reason the calls have all but stopped.Should I be expecting a letter soon with there intent to sue? I have been trying learn as much as I can and figure out what to do , that's the reason I have not talked to the CA yet.
Thanks,
M in N.C.

It really depends. There are some good debt collectors out there. From what I have seen, they do not usually sue. The most they do is try to contact a consumer by phone and mail. If they fail and see you really have nothing, such as assets or money, they will sell it off to another collection agency. You never really know if a debt collector is going to sue. What I would see happening is them giving your information to an attorney in your state and they would be the next ones to contact you, you then have 30 days to dispute the debt.

What is the exact name of the company?

Chances are they just returned the debt to the O.C. for re-assignment. You should at least have 3-4 months of silence before collector 2 of 3 contacts you. When you hit the 3rd collector do be warned this is usually the final CA that will call you prior to suit (if they are going to do so).

Will 100% of ALL credit card debts go to law suits if not paid? The O.C. is Cap. 1 with balance of $1800.00. original was $1000.00 the rest is from add-on fees. Should I call Cap. 1 and ask if its been returned to them? If so, is there any chance they will work with me on a payment plan?
Thanks,
