Illegal loans

I discovered that some or most pdl that I defaulted on are illegal for my state of Oregon. They are all online pdl's. I faxed in my letters demanding that they show my accounts PIF + Cease and Desist. I believe I need to submit a few complaints as well. WHAT DO I ALSO NEED TO DO? CTC garnished my wages and is now claiming they didn't. I have the proof that my wages were garnished. CTC says that they sold my account off to Valentine/SRS Associates. Who claims that I still owe a unpaid balance and they are reporting it on teletrack and worst of all my credit report. SUGGESTIONS ppppppuuuuuuuuuulease!


They are making empty threats. Request for a Debt Validation and if they call request to put those threats into writing and that this call is being recorded. Let them know that they would not see one damn dime until they show me in writing. I am so sick and tired of these a-holes taking us for a ride, stressing us the hell out!

Who is actually collecting the money from your wages? You need to speak with your human resource person to find out. All you need to do is write a simple letter to the company in question who are taking your wages and revoke their right to a wage assignment, then show a copy of that letter to your employer, they must stop distributing your wages immediately, it's the law! Now, on the other hand, if your wages were garnished with a court order, you can't stop it. Based on your other thread, it sounds to me as though this company, or collection agency (which ever) has used a wage assignment against you, please understand that a wage assignment is something customers usually sign when they obtain a loan from a payday lender, BUT, a wage assignment is voluntary and can be revoked at any time.

I don't even know who collected the money from my pay checks because as far I know the company listed was for CTC. According to what I know my employer would not allow garnishment unless it was a court order. I know there isn't any type of judgement against me. I am trying to get this part cleared w/HR. They are in a different state from where I actually live/work. Maybe this was somehow mishandled by HR.
I did fax out a letter to all those illegal pdl's today requesting no phone calls, only correspondence by mail/email, to show my account PIF because I have paid the pricipal + more, to revoke the wage assignment...I mentioned about complaints that I will be filing against them. Now...I just wonder what else I need to do? Should I follow up w/these pdl's if they do not respond in 5 days as I had stated on the letters or should I just keep everything I have on record and move on w/my life?
On another note...I know that CashNet is legal so I went ahead and faxed the agency that is over seeing the account now for a debt validation, their license name/number, physical address. I can't see why this place wants $1k from me off a $200+ debt. I disputed the amount they are collecting me on. IS THAT OK??

I appears you are doing everything you can to clear things up, but I would definitely put pressure on your HR department, tell them you want documentation proving this company has a legal right to take your wages, and I would also send out the wage assignment letter anyway, then email or fax it to your HR department along with the Federal laws that state you have the right to revoke it, if this was in fact court ordered garnishment, you have a right to see that documentation! You can also google your county civil court website and search for a court order of garnishment, it is all public record.

I will be in close communication w/HR-Payroll. I DON'T EVEN understand what had happened. I feel like I have done everything that I can do. I don't think these illegal pdl's can do anything to me. The only thing that I care about is what is reporting on my credit + resolving the debt w/Cash Net. I haven't heard any further collection attempts from the illegal pdl's for a good while now. I guess I can just leave things to rest w/them. I wish they would just show my accounts as PIF because they all have made good $ off of me. I know that I'm not alone. I wish I had found this forum sooner!! I could have saved my checking account and sustained a POSITIVE relationship w/BOFA. Too late now. Thank You so much for all your help. I've been so lost,

I have a few PDL's that were turned over to CA's. The CA's reported the debts to the CB's and they are now on my CR. How can the CA's do that when THEY even know that some PDL's are illegal? What can I do about this?

My HR sent me the wage forms/ALL docs that CTC had sent them. That was all that HR needed to allow the garnishment. Had I known that I can revoke this wage assignment deal I would have. The amount has been taken in full and I don't plan to get the $ back some how. My prob now is that CTC won't mark my account PIF and they are the ones who got the garnishment for a fact! They sold it off to SRS and I know that SRS reports this to the CB's. They reported DEBT DR and ARROWHEAD on my CB. I have already paid those 2 debts so I am waiting see if my CB will update in the next month or 2. SRS should have never gotten the CTC debt. I don't think CTC is Sonic. I believe that CTC is connected to Northway Financial. Northway is the ach debitor. I HAVE NO IDEA how to get these people off your CB's. If they are debts that you owe you should just pay for them. I have found in my case that both Debt DR and Arrowhead were LEGAL and even asked to settle for less. Just cross your fingers they will do their part and update your Credit Report as PAID.

At this point, with the info you have, I would stop writing letters to the CA and IMMEDIATELY contact the FTC. Provide the FTC with the info you have obtained, show them the proof that CTC took all that money, and then show how they not only refused to mark it as PIF, but ALSO that they then sold it to another collection agency AFTER they collected the full sum of the debt and then some. File all of this in a formal complaint with the FTC and let them help you. This company has broken so many laws from what you have written, I would go after this like crazy if I were you!
