I have a creditor who has finally found me. My last payment date was 1-21-04 on this debt. The debt was accrued in California, and I live in California. I have found out the the SOL for California is 4 years. So basically I have found out that they can't sue me correct? The CA is The Law Office of Vincent Cignarlae. I am at a point in my life where I can begin to repair my credit. With the debt being this old, is it in my best interests to pay, or should I send a C&D letter, and just wait for it to fall off of my CR in 7 years or so? I'm new here, so any info would be great!

Rather than trying to settle for less than the original amount, perhaps it would be better to try to negotiate with them about whats on your credit report. I would see if they would be willing to remove the report from your credit file entirely if you pay the amount in full.

ok, hang on a second here. I just realized who the CA is that you mentioned....you need to do some homework here:

This guy is bad news--he's affiliated with one of the absolute worst debt collectors in history. They manufacture phony documents, lie in court, and a whole host of really illegal tricks. Not one case this debt collector has ever brought to court has seen him produce accurate and legal documentation that proves anything about the debts he sues over. And the lawyer you mentioned is now on board with that collection agency!

You should get 100% full documentation of everything they say, from the amount of the debt, to the dates involved, to any agreements you enter into. Get EVERYTHING in writing or dont agree to it.
