In June 2005 I sent a request for Validation to Asset Acceptance, about ten days later I received a letter from their Staff Attorney, Carrie Taylor, stating that she had reviewed the claim and it SOL was still applicable (SOL expired in Sept of 05). That she had requested the necessary documents from MBNA and they would be forwarded on to me.

During that time frame I was recovering from shoulder surgery, separating from my wife, finding a place to live and arranging the custody of the kids. So obviously AALLC was not a priority in my life.

To the current time, at the beginning of the month I sent them another letter stating I have never received the info that Ms. Taylor said I would (they always had valid addresses on me) and once again I requested they either VALIDATE or remove the entry from my Credit Report. I included a copy of my original request and Ms. Taylor's response, copy of the complaint I filed with the FTC and California Attorney General.

I also sent a copy of the letter and it attachments to all three CRAs.

Three days ago I got a letter from their Cleveland office (all other corresponence came from Michigan) with a statement, on their letterhead, stating how much I owe, the last four of my SSN, MBNA's name and an account number that I cannot find in my records and MBNA never listed on my CR.

I am sending them another letter (all letter sent have been with wording from this site) stating that they still have not provided legal proof of this debt and either to provide it or remove it.

Question: Obviously they will never validate the debt nor willing remove the entry from my CR. They will "verify" the debt to the CRAs. How can I get this off my CR?

Sorry for the length but I thnk I got all the pertinent info.
