I live in Indiana and was just advised that my wages are being garnished by these guys, they must have bought an old debt. How do they get away with garnishment if I've never received a summons


I just bought the report from the Marion County Court and this is actually just a questionnaire for an upcoming appearance. On 5/9/07 the case was filed, on 5/10/07 it shows a summons was "left in door", then there is a long history of being disposed, re-docketed and so forth. What type of attorney handles cases like this?

I was misinformed, the certified letter that my office received was not for garnishment it was for information on my wages. I have a court date of Oct 5th to determine whether I will be garnished. I never received the original summons, Indiana law allows them to just be placed in the area of your front door without actual physical acceptance so it could have blown away. AS for the debt, I don't know... I was called by a company years ago demanding this payment so I asked them to identify what it was for and they couldn't, then my bank account had a freeze put on it and they were awarded they money but had to return it, the money went back into my account and that was the end of it until now. Two days ago my daughter received a new summons (I'm in Dallas on business) for the appearance on the 5th.

Okay, now that I've returned from Dallas and I am in my office I've discovered that they do have a judgement against me for the sum of $4400 and the court date on the 5th of October is for a garnishment proceeding. As for the question regarding the original summons, No I never received it the court documents show that it was placed on my door with tape??? The state of Indiana evidently allows this for of serving summons.

How do I attempt to find out what the debt is for? I have no idea what this debt is or if it is valid... Help is appreciated. Thanks--- Joe
