I did infact say that we never filled out any forms other then one credit application for a VISA home projects card. but he said that they hold a secured interest on the unit though not once is the unit named or mentioned anywhere on the paperwork, was just a credit app.?it and can come get it. he said he can get a court order and will show up with all needed technicians to disconnect the unit. what can we do? plz help.:(

I work for capital one and I know about almost every card on the market. I have never heard of a credit card that allows the company to repossess the item if you don't pay for it. Is this a credit card or is this some sort of program with the store? No CC company can repossess your items. However, if this is some kind of program with the appliances store you bought this from they may be able to. You need to give us specifics, i.e. the exact company so we can do some research.

Sorry for lack of info, we applied for a VISA projects card, and we have the actual Credit Cards.in hand. through wells fargo. and began making payments on the card until job was lost, etc. then after several months wells fargo sent a statement sayin it was being charged off or sent to collections. then we begin getting calls from "admin Recovery" sayin they want money or they are going to come take the unit from the home. and claim they will bring contractors etc to disconnect. I did say this was a credit card purchase he stated "oh we have a right to the unit, and can come get it" and is asking to send money, we want to clear this up and want to make sure we arent paying a place, then finding out months later we paid the wrong place. this is hard being so down in life that you cant sleep at nite due to these calls, added to the stress of not being able to get a job. thanks for any help bless you all! for your concerns and caring.

With regard to this CA, I am doing some research. It appears that this is a special type of STORE card, not a credit card. It appears that the agreement states the following -
The terms for the Home Project Visa Credit Card contain general terms, including:
Security Interest:
To the extent permitted by applicable law, you hereby grant
to us and we are retaining a money security interest under the Uniform Commercial Code in the merchandise purchased on your account . . . . If you do not make a minimum payment due on your account by the date on which it was due, we may repossess any merchandise that has not been paid in full.
This is a very strange store credit card set up through wells fargo that is actually serviced by the business it is issued to. I am not a collections expert so I would wait for soaplady's opinion, but it looks like they can repossess the item. As I suspected this is some very abtract store agreement. It actually went to federal court to decide if it is a legitimate agreement or not as someone tried to declare bankruptcy with it as unsecured debt, and the court found that the debt was secured. Is a good thing as we have been tryin to get wells fargo to work with us for months on the payment per month, and they wouldnt. yet now this co. says to give them 849.00 and pay 50.00 per month, which is what we can afford at current times though we are happy to finally be able to clear this up,. as our credit before job loss was 820's and this being our only unpaid debt im sure its about 250's now :( job loss really does hurt and will take years to recover. thanks to everyone for the help. bless you all!
