Writing a counterclaim
Date: Mon, 04/14/2008 - 22:06
Hi, I am writing my counterclaim and request for a
transfer to a regular civil docket. Is there any information I should not say in the letter? Should I be very specific of the violations? I typed up 2 pages so far and I have about 3 more to go. I have them on
fraudulent documents, not sending a initial communications notice with disclaimer. First contact was manufactured documents 30 days later was a lawsuit.
They never verified the original account with my credit report and put their own account number and name.
The list goes on and on. I also feel I have them for extortion and slander. I think so far I have found over
$20,000 in violations on their account not including
punitive damages. I told them the account can't be mine because if in fact it was charged off in 2006, the credit report companies would have it in their records.
Furthermore the item should be charged off and on my credit report till 2013.
I hope someone can give me some insight on this. Everyone here has been very helpful.

Go down to your local county law library and ask the reference librarian for the forms. You will find them in the form books in the library. They may even have it on CD so bring a floppy disk with you.
