Got a letter from Mitchell N. Kay stating that I owe Palisades Collection for an AT&T debt. I am not disputing it, I do owe it. Called both offices and neither can send a letter saying that if I pay in full that it will be marked on my credit as PAID IN FULL. Mitchell N. Kay says they don't make the report to the credit bureau and Palisades says they don't take the payment...which somehow makes sense, but...How do I get it in writing that if I pay in full, my credit is marked paid in full? Thanks.


Faerona, first check when you last paid on this account. There might be possibilities that the debt is out of the SOL period unless you have done any payment recently. If the statutes have expired and this debt took place 7 years ago, it won't come up in your credit report.

You can check the date of last payment in the latest credit copy or inquire it directly with the original company. The collection agency is also bound by laws to give you the debt validation of this account with correct information. Did you get anything in writing from them?

if they accept the payment ( who ever it is ) they should send you a letter stating the debt is paid in full. With this letter , you can then open a dispute with the CRA that the debt is paid and provide the letter as documentation.

You have a few options.
First, refuse payment until they will put the agreement in witting.

second, go ahead and send the payment (DO NOT SEND A PERSONAL CHECK). send them a cashiers check or money order, along with a letter explaining the payment represents payment in full based on the balance stated in their communication. and that you will not accept legal responsibility for any additional charges or fees. Send this CMRR, upon receipt of the green card, wait about two weeks then start calling and writing them demanding a letter stating the account is paid in full. Once you receive this, wait about 30 days, then pull your credit reports. IF the account is on there and showing as a open collection or showing a balance, then dispute it with the CRA, providing the letter from them showing the amount dues, the stub from the Money order or cashiers check, CMRR receipts and (hopefully) the letter stating the account is paid.

If they report this account, they are legally required to up date the status when they receive payment. If they fail (or refuse) to do so, then you have remedy allowed under the laws including suing them for up to $10,000 plus damages for violation of the FCRA.
