talking to debt buyer

i was recently on the phone with a debt collector that bought an account from capital one regarding my husbands alleged account, i asked for validation and was told I already we received it in the letter saying it had been assigned to litigation department. I responded that we were unsure if we owed this. they said they had statements i am guessing they meant monthly statements from original creditor. when I asked what purchases were made they said cash advances for 2500.00 ok so i pulled my husbands credit report and it had the alleged card listed with a 2000 limit so how did who ever used this card get 2500 just in cash advances do credit card companies not just let you have a certain percentage for cash advance? They tried to get me to agree to paying them and discussed what we could afford I replied that we didn't have anything and we lived primarily on my social security disability and that I couldn't afford much because my husband is self employed and seldom gets to work. They tried every way to get me to agree to pay its not in my name! I told them that I was confused about the debt and unsure if my husband even had an account its from 2008 by the way.I told them that we were going to get advice that evening from an attorney about what further action to take did i hurt him by speaking to the debt collector? please help

Paul...discussing it with a spouse is NOT an FDCPA violation. The only state that requires permission between spouses is Mass.
To the OP....send them a debt validation letter in writing via certified mail return receipt requested. They do not have to send you squat on a verbal request.
