Can someone tell me if this is legal? I had an account with Chase that went delinquent and was charged off. They ultimately sent it to a collections company that decided to sue me and I was served papers. I paid off the collection company a settlement amount and the court was to be notified of this so everything was to be closed out and I did not have to go to court. I now have noticed on my credit bureau report another collection company showing the balance that was charged off in the settlement and they are trying to collect on this amount. Can they do this when I thought I had already agreed to a settlement after being served papers and took care of that amount?

thanks

The collection agency to whom you earlier paid must have given you the PIF in writing. This written statement could have proven that the debt has already been paid and you don't have anything due left.

I will assume that since you agreed for a settlement amount, they have sold the remaining balance to another company that is now attempting collections. Get the 'Paid in Full' letter from the first company so that you can prove the debt as paid to this company contacting you.

I paid Mann Bracken a settlement amount back in 2003 or 2004 for a Household Bank credit card that had gone delinquent. I even received a Paid In Full letter from them acknowledging that I had paid if off completely. Now, 6 years later, I'm getting calls from Regent Asset Management saying they bought this debt and that it shows I still owe it!! Can I contact MB and ask them for proof that I paid if off? I can't seem to find my records anywhere!!!! Eeeek!
