Technicality on a late on my CR

I have a 30 day late being reported for Feb of 08 on my mortgage. I have proof that a double payment was made on Feb 11 (for Jan & Feb together). Therefore, Jan payment was 30 days late, not Feb.
The mortgage co says that nothing is being reported incorrectly and they dismissed my dispute. They stated that since Jan payment was made in Feb, that is why it is being reported on Feb. They have the payment info correct in their records (double payment on Feb 11).
So technically, shouldn't they be reporting Jan 08 as late and not Feb?

I'm not sure if this is correct but here's my thought ~ You're Jan payment was not 30 days late until February...so since that's when the deliquency occurred...that's the one they reported.

Creditors report "late" during the month when a delinquency occurred, not when the payment was due. On 01/31/08 your account was not yet 30 days past due, so they couldn't report delinquent for that month. The delinquency actually occurred in February, so that's when they report it.
Suppose the Jan payment was due 01/12/08. It was 30 days past due on 02/11/08. They are correct to report the 30-day delinquency for Feb 08 because that is the reporting period during which the delinquency actually occurred.
