Hello All... I have some questions. I don't seem to understand my credit report. I know for a fact I had three credit cards. All of which I made a last payment in jan 2000. That is out of SOL for the state of Texas. But on my credit report for example... There is my MBNA card and it says written off i assume because its out of SOL then there's a comment that says another lender purchased that account. Well then there is an entry by assest llc which says Status: collection account as of JUL 2006 orignal creditor: MBNA...but its a different account number than the other one...I only had one account with mbna...why would the account numbers be different? What does Collection status mean? does this mean it has been reactivated? ...but i haven't made payment since 2000? please help me understand.

Are you sure about the last payment done in the year 2000 and there was no activity after that? If this is the case, no company can force legal actions against you and ask for payments. Make sure that if you make any agreement or a payment towards the account, the SOL will get renewed. The company will take a recording of your statement and hold it against you saying that the SOL has been renewed.

I guess there are possible errors in your credit report. Asset Acceptance may have purchased the account and they tried to re-age it. It does not renew the date of last activity and the SOL. Dispute this item with the bureau reporting it for investigation. They will correct if your dispute is correct. Keep a copy of it for your records.

these people called me from an attorneys office...i'm guest101 but i've registered now my id is angeles_17...they told me they were lawyers and they said that felony charges were going to be charged against me in 24hours...i asked them what should i do...well because i thought they were in fact attorneys...i know stupid of me...but any way i told them i dont have a way of paying but that i would call them back to make some sort of arrangement...well my husband called them and said he would give them the check account info...before we did thta thought we did a search for the law office and we found your website and bud hibbs with lots of negative things about them...so we did not call them back. are you saying they can use my husbands and my converstation with them against us even though no payment was made?

What is the amount of debt? Is it too high? They might represent your conversation as your consent of paying the debt, however, I would suggest you consulting your state laws for this. Remember, no legal action can be taken against you if the SOL is over, but be careful of not to restart it again.

Send ???em a letter stating you are not going to pay a past SOL debt. Also dispute the item with credit bureau.

SOL is renewed if there is a proof of the payment done after the expiry of the SOL. Also, you don't know if they have recorded the statement or not. If yes, they might try to hold it against you. Ask them for a debt validation, first. This way you will be sure about them having your account and paying to the right company. If they try to hold the recording against you, you can use your legal means of the debt validation request not honored by them and you do not want to pay to the wrong company. I am thinking two steps ahead if this matter reaches the court.
