I have over 70k in credit charge on my credit report, all are due to identity theft. I must file a chapter 13 due to my income, but my attorney insists that I have to pay these creditors in the plan, which of course means I have a high plan. I seems that I should not have to pay those.

Did you consult any bankruptcy attorney?

Firstly, you have to be eligible to file Chapter 13 bankruptcy. The total debt should be less than the predetermined amount which is adjusted at regular intervals and you must receive credit counseling from an approved credit counseling agency in a period of 180 days before filing your petition. Depending on the situation, I believe your attorney will be the best person to advice.
