Stuck with Mail Fraud Debt

Hello All-

I am in the process of disputing a charge on my credit report. In my review of the reponeses from the credit agencies, I notice an item that isn't mine.

When I was in FL in 2004 I was a victim of what the police called mail identity fraud. Essentially, people pull a name and address out the phone book, go to a store and open up an instant credit account using a random social security number. There were a total of two accounts opened and one denied. I only knew about it when I received the bill for the two accounts opened and a denial of credit for the third account. I was also sent the credit cards

The person charged over $300 worth of items at Bloomingdales and Burdines. I checked my credit report immediately and put a statement saying that if anyone wanted credit I needed to be contacted immediately. I also contacted both of the stores, filed a police report and even did a notarized ID Theft Affidvant all of which I kept copies of. Also when the cop came to interview me, I turned over the credit cards as evidence.

Of course now, all these year later, the charge for Burdines has showed up my credit report. I have not received any collection notices from them.

I filed a police report which states that states that the case was "unfounded" because my information wasn't used to open the accounts. My social security number wasn't used. My name was spelled incorrectly and my full address wasn't on the application. (The apartment number was missing).

In the police report the cop spoke the director of Loss prevention at the Burdine's where the account was opened. He also verified that the DOB was not mine and the social was not mine. All of this is in the police report. So even the identify theft was unfounded. Burdine's confirmed that this was not mine. They even say on the police report it was their mistake and they would correct.

But now 5 years late it's on my credit report. I still have copies of everything. So what do I need to send to whom, etc.

Burdine's is reporting it. Even though I have the police report with the interview with their Loss Prevention guy saying I am not responsible.

So far it is only on my Transunion credit report. My question is how did it show up on my credit report if they admittedly didn't have my SS# or correct date of birth on the original application?

Also I want to do something more than just requesting it be removed from credit report via the credit agency. Usually when they "investigate" they always find in favor of the creditor. Clearly some laws have been violated. Are there any official acts from which I need to quote.

Also do I send them copies of the police report, identity theft notarized affidivant, etc.

I just need some specifics.

Hi-

I know this one has been a while but just wanted to follow up. I sent copies of all my stuff a very harsh letter to the VP of Macy's (Macy's owns Burdines now). They responded promptly. I think it was within a week and they cleared everything up with many, many apologizes. The item was removed from my credit report within 30 days.
