I sent out a request for direct negotiations to a credit card company that has negative marks on my credit file. they sent me a letter back saying:

The above referenced account is no longer owned by *******. It has been sold to HILCO Receivables. If you have any any questions, or need additional information, please contact them.

What should my next step be? Should I negotiate with the Collection Agency for pay for delete? I don't have the CA on my file -- however, I DO have the OD on my credit file -- should I dispute this with the credit bureaus???

Please help!


I received another letter from another OD this weekend. Basically, they are saying the same thing:

Thank you for your recent inquiry regarding the above referenced account.

The ownership of this account has been transferred to Resurgent Capital Services.

We have forwarded your inquiry on to Resurgent Capital Services on your behalf.


Should I dispute the status of the account with the credit bureau? My credit report shows this account as closed but as a charge-off still with a balance.

Should I also negotiate with the collection agency?

Regurgent, oops I mean ReSURGEnt is a JDB! Junk Debt Buyer. They buy debts for around 2 or 3 cents (up to 10 cents for newer debts) for old uncollectable debt. They are a part of LVNV and other such wonderful neighbors!

See "http://www.budhibbs.com/collectorpages/LVNV.htm" and cringe. But if you're not afraid of defending yourself, it could be payday. Document *everything*. They will likely break the FDCPA rather quickly in a documented manner, which will enable you to fly to court and collect $1,000 plus possible court costs and attorney fees!

Has Resurgent sent you the dunning letter? If not, wait for it, and then send then a Debt Validation letter.
