Removing a Foreclosure

I have a foreclosure on my credit report which I'd love to have removed. I know the standard response, this stays on your credit report for 7 years, 180 days... But I know there are people who have gotten these removed. I've been trying for about two years, off and on, but without success.

I've written disputes to the lender, Wells Fargo. I've disputed with the credit agencies. It always comes back as verified, no change.

Has anyone here been successful in getting a foreclosure removed?

I think my next step is to try some sort of "produce the note" debt validation, and if they can't, demand that the mark be removed from my credit report.

The other thing that I might try, is to dispute with the credit agencies that Wells Fargo had no standing to report the mark, as they didn't own the note.

But I'm kind of grasping at straws here. Conversation and thoughts are welcome.


Actually, the vast majority of foreclosures in the US are non-judicial in nature. I can also pretty much guarantee that Wells Fargo does not have my note, but showing that they can't produce it is hard, short of taking them to court. And there are people who claim to have foreclosures removed, which makes me think it can be done. So that's what I'm looking to do.

It's about disputing the mark, but doing it in a way that paints the creditor into a corner where they can't back-up their reporting, thus needing to remove it. And that's where I run into a wall.

The best way is to see if your loan was securitized, you can do this through the edgar database, which shows sec information. If you can locate the prospectus and pooling and service agreement, it will show you who the real owner of the mortgage was. It was not b of a or wells fargo (for example) they had no right to report anything to the credit bureaus. Once you have that information go to small claims court and file a lawsuit for 1,000 dollars against the lender who reported the foreclosure. Then find out who the lender's general counsel is. Can find out through your states corporations commission. Send them a copy of the lawsuit along with a one page summary of information found on who really owned your loan. They will contact you, and then tell them to remove the negative item from your credit reports, or you will see them in court.
