Help with 18-year-old daughter's credit

My daughter just turned 18 and we checked her credit reports because she got a letter from one of her employers saying their payroll dept had an employee take SSN's, etc. and to check their credit. Well, it appears that she had a Capital One card opened (not by her). We found out it's her aunt (on her dad's side, who lived with us for about a year). She had gotten this in my daughter's name and maxed it out, paid a little on it, but then let it go. We don't want her to go to jail for it, so we don't want to press charges, but how do we go about disputing this? Should I just use the ideas on here as far as debt validation, etc. first, or would it help if her aunt signs a notarized paper taking responsibility for this and agree to have it put in her name? This is about a little over a year old now. I don't want my daughter starting off her life with bad credit! She has college coming next year and we want to apply for loans, etc.

Go to http://www.ftc.gov/bcp/edu/microsites/idtheft/ and have her fill out the IDT Affadavit and tehn have it notorized. Send that, the police report, proof of ID and copies of her credit reports showing all fraudulent accounts and inquiries to all 3 credit reporting agencies. They will place a 90 day fraud alert on her reports and suppress all fraudulent accounts and inquiries. Hang on to all paperwork. I guarantee she will need it at a later date.
