Summons Help??

Long story short, we got in some serious financial difficulties a few years back and couldn't pay our credit cards. Consulted a Bankruptcy lawyer and he stated we were not good candidates for bankrupcty at that time. He instructed us not to pay our cards. That was nearly 3 years ago. Our situation really hasn't changed very much, still struggling to make mortgage and car payments. Not enough left over to pay this past due credit cards. We have been getting harrassing phone calls and letters constantly. He informed us not to respond due to it starting the Statue of Limitations all over again. Now, I recently was served a court summons for a credit card debt. This is the first time I have ever received anything like this. I am at a loss as to what to do next. I don't have the money to pay the account in full. Any help would be greatly appreciated.

Also, the account number on this summons does not match the account number on the account in my credit report. Does that buy me some time.

Account numbers do not always match....your original account number was probably the card number. When assigned to a CA/law office, they are assigned an in-house account number, different you your credit card number.

You need to answer the summons or show up in court or they with get a default judgement against you. They would be able to garnish your wages (if your state laws allow it) and/or seize your bank account.

You may want to consult another bankrupty attorney or google "bankrupty means test" to see if you are a better candidate now.
