CA reporting unvalidated debt on CR

UCB Collections is reporting a debt on my CR that they have not validated. I disputed it with the credit bureau and it came back verified. I just got off the phone with a law office who stated to me that they can still report it on my CR even though it has not been validated. They haven't even provided me with the name and address of the original creditor. According to the law office, they are not legally obligated to provide proof that they are legally authorized to collect the debt. So I guess that's stuck on my report until 2014 because I'm not paying them.


Its a medical debt for $375. I got a letter from UCB, sent a DV, received nothing. Got a letter from an Alexandria Vaneck who is an attorney associated with them, sent a DV, received a confusing computer printout, sent another DV, received nothing. Noticed UCB reported on CR, sent another DV, so far received nothing. None have supplied name and address of OC.

At this point, don't care. Have a bankruptcy anyway on there set to come off in 2011. Just don't want to be sued by UCB.

I disputed it once with the CR and it was verified. Disputed it again and CR stated it had already been verified.

I have had to deal with a few collection agencies and learned a few things. Firstly, they are not going to sue you for a $375 medical bill. The amount is too small. Secondly, in court they would be required to validate the debt. The fact that they haven't responded to your DV leads me to believe that they just don't have enough information to prove that the debt is valid. And finally, they will not remove the collection from your report unless they are compelled to do so. You now have two options: (1) File a complaint with your state's attorney general's office (AGO). They usually respond to the AGO. If this doesn't work, (2) you may file a suit in a small claims court against them, asking that they validate the debt or remove it from your credit report. They will not show up, and you will get a default judgment against them. Send this judgment to all the credit bureaus and they will delete the entry from your credit files. Good luck!
