Both state they are attempting to collect for Asset Acceptance. Including the account with incorrect name still being used!!
Sent validation requests regarding both accounts and after 6 weeks, or a bit over, I never heard back from the original letters.
Now, as I can get new letters printed, I'm gonna send several new letters out, CM-RRR requesting validation of account(s).
Is there anything else I should do first, before sending DV letter(s)?? Probably won't be going out until next week anyway. Post Office closes at 3PM, I'm stuck working until 4PM! :-) But, 4 day weekend next week, so I'll send letters then.......

There is literally nothing to be done until you get this account with proper details. You can only get that with a proper validation request. If the company has sent you something in writing about this account, debt validation won't work at this point. You have to dispute by requesting more information. Debt validation letters are sent when the company does not send you anything in writing to you. Dispute letters are sent when you have received something in writing but it misses the necessary information.
After sending the letter through CMRRR, they will send you a mail confirming the receipt of your letter. The countdown will begin from that date and you are required to get the necessary information within 30 days. If you don't hear anything from them, send copies to the bureau and explain the part of the company's failure to give you the account details. The bureau will involve in the process and get the item verified. If they don't receive any response, the item will be removed from your file. The bureau is also required to reply you within 30 days. That's the process of reshaping your credit report while doing the repair work. Lots of patience is involved in this process.

Here's the situation:
I sent a validation request, CMRRR, to Assett.
Got the green card back. But, I never heard a peep from AA regarding my request. Apparently, instead of following up with my request, they passed the account on to another, in this case, CMC.
So, I'm thinking I now need to request validation etc.....from CMC, dispute the info, whatever...?
They, CMC, is even trying to collect the account with the incorrect name that I sent validation request for also!!! Gotta get them to validate that too I guess.
Anyway......This is MY opinion of what I feel I need to do next, since I never got the information I requested to begin with.

Yes, you need a validation from CMC. That's the worst part when the CA instead of validating the debt passes it over to some other agency. Why don't they do some proper business instead of wasting time?!!
Also, ask CMC to prove the account with the incorrect name? If they can't, you must dispute with the credit bureau. It is the responsibility of the credit bureau and the information provider to present your credit file in accurate shape. Use your legal consumer rights to get that done if it doesn't happen in a fair way.

I sent out 6 or 7 validation letters in the beginning of January, and I have not heard back from any of them. I suspect they are going to do to me what they did to Keith, and just transfer them to another CA. This is just going to make it harder and harder for the next CA to validate the debts.

This goes on getting tougher and the accuracy of the account keeps losing every time. I guess, the federal system can do something on this area. Check out the whole discussion.

This caught my attention---and I have to ask you about this because I may have done something wrong. I heard from collection agencies on the dell accounts and sent them validation letters. They weren't dispute letters, they were validation request asking for all the info on the accounts. (2 agencies with 2 accounts each) These are the same accounts that were getting passed every time I would ask for validation. The last agencies to have them, still have them I guess, but I haven't heard anything new and its been three months. I wrote credit bureaus and they came back and verified the debts but I still haven't heard anything. So did I do wrong by asking for validation? I wrote Dell again and both times have been told that they are no longer servicing accounts to talk to collection agencies. well collection agencies won't talk so it feels like I'm chasing my tail. Equifax WAS reporting a balance on all four accounts, now they have 'updated' and show '0' balance on three of the four accounts and updated the status saying 'paid/payment after charge off'. does this mean they've been sold? The other two bureaus don't show this update.

So do I need to mail out 'dispute' letters now? since I did get statements in the mail from collection agencies and sent them a 'validation' request? maybe I have messed up here? shirley

The first thing when you get from a CA in writing is what they call debt validation. Maybe that's the way they treat it if the debtor does not dispute on any item sent in the details. If he agrees to everything written in the paper, he will pay it. The matter is settled and the account is over.
But if the person does not agree to what is written in the paper, he has to dispute on the given information. Send a dispute letter and hope that it works, this time. When you have tried so many ways of resolving this matter, try this one as well.

These accounts have been passed around so much, and dell won't talk to me, they say talk to the collection agencies, so now I'm confused about 'WHO' even has them anymore. Its been three plus months since the last time I heard anything about these accounts.I'm thinking of writing Dell again and asking 'who' actually has these accounts--names and addresses so I can write the CAs AGAIN and hopefully get something back from them. If Dell 'sold' any of the accounts, do they have to tell me if I ask them??? thanks! shirley

I have two debts. One secured auto, never repossesed because overseas for 15K is no longer on my CR. Two, a charge off credit card in Asset Acceptance hands which should come off CR in 01-07.
Problem is I must make settlements with both because my employer requires all debts to paid, so I am hosed on the out of SOL loans here. Question is what is the best way to settle these without having a paid charge off for another 7 years on my CR? The car loan is off CR, when I settle will it reappear on CR?
I absolutely hate to deal with AAC, but am in a corner where I have to now. Any suggestions appreciated.

Globetrotter...if these two debts are out of the SOL, your employer should not even be able to find out about them, because they should not be on your credit report, unless they are less than 7 yrs old I guess. But, if you pay anything on them...even if you pay them off, yes..they will reappear on your credit report and the seven years will start over.

Thanks, my employer is uncle sam so he will find out even though not listed. Frustrating because car is off of CR and the Asset Acceptance will fall off next Jan in 10 months.
I need a job more than having a black mark on CR. Can debt consolidation negotiate paid as agreed on CR if I make it in payments instead of settlement?
I am down to three entries on my CR and only one bad, but to have a clearance and security credentials I am forced into a box on this. The govt look at it as it is out of SOL but you still owe it.

I guess you can sign up or call the number and ask the representative if they can get it marked 'paid as agreed', but really it may not be up to them, depends on who you are paying to, and it is really not likely. If I were you I would just try to pay in a lump sum...gets it off your CR faster...plus if you start making payments, you probably start the phone calls all over, especially through Asset.

Guess, I'll have to suck it up, instead of having a clean CR in 10 months, will have another 7 years, but only one entry so still better than 3 years ago with 50 entries when I owned rental properties. Don't know if to deal with Collection Agency or tell them cease and desist and deal with Original Creditor. Seems I would have less to pay dealing with OC?

Hopefully they have not sold the account and you can set up payment arrangements and get it back to the OC. Just call the OC and see if they have sold it. Good luck with that, hope it works out in your favor.

CMC, in a lack of smarts, has decided to apparently resend a settlement offer letter. I'm thinking that this is for the same account I requested validation for previously.
Do I attempt to send another DV letter CM-RRR and hope they are smart enough to reply??

They cannot start collection activities without validating the debt. It goes against law. Do you have the signed green slip of your previous DV? You can write to them that you sent a request for validation dated ??? and they haven't validated yet. So how can they claim money? They should validate first.

States to please take care of this by one of the following methods:
1. Pay by Credit Card - Visa/Master Card
2. Mail FULL amount by check or Money Order
3. Contact office to arrange payments.
Here's the deal:
1. CAN'T pay by credit card. I dumped mine LONG ago with NO plans on getting another one. To risky.
2. They're crazy if they expect me to send THAT kind of payment through the mail! Besides, I no longer have a checking account either!! Dropped last one after they caused me may days and many dollars worth of trouble!! No plans on getting new account either.
3. NOT going to pay what can't and hasn't been validated!! Just how #$%&( hard is it to send the required information??
Granted IF proven it would take a MINIMUM of 6 MONTHS to get money together. Expect me to pay just under $1,450. More like $1446.36 to be exact. But then as I see it, they don't deserve to be paid! JMHO.
Anyway.........I could use a good validation letter to send back. As always, Expert? :D :D help and/or advise is greatly appreciated!!
