My husband has a loan with American General Finance. He is two months behind, but will be able to catch up in the next couple of weeks.

I came home today to find a note from the local branch taped to our door. I was SHOCKED! Are creditors allowed to show up at your front door like this? I feel this was VERY threatening...that would have had to MapQuest to find our home.


I had this happen to me once in the early 90's, but didn't think it was commonplace. American General could have just sent a certified letter and would have had proof that you received the letter and signed for it, rather than hand-delivering the note. I would be tempted to write a complaint to their corporate office.

Yes, many states have laws based upon the FDCPA77. For a number of them, the laws may also apply to the original creditor as well. Many of the same exemptions come into play; debts that are not legally considered debts (business, non-profit (?), government debts-although fdcpa adherence may be mandated, etc.). Which brings me to an idea. I'll post a new thread about it.
