There is a collection agency called Knight Adjustment Bureau, and they actually have an interest in Best Cash Advance. Therefore, they can try to collect on defaulted pdls, and can get around following most fdcpa regulations as third-party collectors are required to do.


However, the fdcpa clearly explains that an original creditor who uses any other name than his own while collecting a debt is required to follow the FDCPA:

... "the term [debt collector] includes any creditor who, in the process of collecting his own debts, uses any name other than his own which would indicate that a third person is collecting or attempting to collect such debts." ...


So if you took your loan out from Best Cash Advance, and then Knight Adjustment Bureau starts calling you, I would: A) make sure they're providing all the 1692g disclosures and mini-miranda; B) demand validation; and C) send a cease and desist. If they don't adhere, then they are violating the law.
