I was able to get a refund from them - $400+ and a paid-in-full letter.

ok, I am sick to my stomach right now. Wells Fargo let some payments post, and I called in to freeze the account. Well they asked me questions that now bother me and told me its under penalty of perjury that my statement is true. I thought I had a right not stop ACH withdraws with out getting into trouble... Please help I dont want to be introuble with the bank. I am scared these companies will try to say I never sent them anything.

Obviously, they need to be reminded about the electronic funds transfer act whereby you can stop/cancel ACH transactions. Call Wells Fargo and ask to speak to a Manager, not a teller. Tell him what happened. and if they don't stop/reverse the transactions, you will take your business elsewhere and report them.

I had a slight problem with Commerce Bank (now TDI) and had to go through 3 different departments before I found someone who knew what they were doing. They froze my account to ALL ACH transactions (not just PDLs), reversed the ones that had gone through illegally. I had opened another account for my direct deposits and when they came through the old account was closed.

Don't let them intimidate you. You have rights.

what I did was emailed them revoking any ach... I told them that nothing should be allowed to go through. And I called and froze the account asked them not to allow anything to go through, and the next day they did. neg. $580. Then they called me today to discuss my e-mail and told her I sent out letters to all Illegal PDL's last week on 11/24/09 notifing they I was revoking my ACH. I told her I also faxed and emailed them too. I told her I filed my complaints too. She just made me feel uncomfortable with the whole perjury thing. These PDL's are illegal of course they are going to lie about not getting my ACH revoke.

I didn't edit this, I meant to quote you and instead chose the "edit" button. Whoops! Shazzers

Was this the bank manager you spoke with?

No, some people at the faud department. I print all my e-mails that date back to 11-21 showing that i was attempting to close the account since then. I am waiting for the Bank manager to get back from lunch. I just dont want trouble from the bank I have enough going on with the illegal pdl's.

I know how nerve-wrecking it must be for you, and trust me, it was one of the hardest things I had to do, but what you should have done from the start is go into your bank and personally explain your situation and provide copies of the your ACH revocations and letters to the PDLs to a bank manager or officer, not a teller or customer service person. It's been my experience that phone reps don't have a clue and will have you wondering if you're the one doing something illegal and not the PDLs.

And any bank employee that tells you that you cannot revoke any or all ACH revocations should be fired. If you were dealing with ethical and legal companies, your bank's concerns about the transactions might be warranted, but you're not dealing with legal entities here and the bank should help you protect your account.

I just called the branch manager and he is going to monitor the account and get it closed out. he reasured me the worst that can happen is they find the charges true and I have to pay the bank for them but he said he deals with this every week and I should be just fine. I am so tired of breaking down.

i agree, i would perhaps even go higher because the manager still does not sound too reassuring. how would they find those charges true?? you can revoke any ach at any time. i know how hard this is (the bank was the worst part for me) but maybe you can get what he said in writing? like an email or something? i would not trust him.

well, I will tell you i never want to be in this situation ever again... And this site has helped me with support from everyone. and yes dealing with the bank I think is the hardest for me. I have been with them for 9 yrs and this is the first problem I have ever had. I think its more shame than anything. I am completely ready to deal with the illegal lenders cause of everyones support and knowing I have rights. I just hope when this is all done with I can provide the support back to this site.

Jasgal

I have had problems with WF in the past as well. They debited my account twice for a cable bill that I did on the debit card... needless to say it overdrew my account and of course caused other things to go awry... even though it was their fault - they told me it was a computer error that there was nothing they could do. I had to go in and sit down with all this paperwork to get it straightened out. Like someone above said. GO IN and don't deal with the "customer service" on the phone. They don't know what they are talking about all the time and end up making the situation worse. The bank manager will be able to sit down with you and go over things better. Don't let grouchy people make you nervous either. Chances are that the person you talked to on the phone is actually in a similar situation and was just irritated that she didn't know about this site and all the great information that was learned. Hang in there! The bank doesn't really want to lose you as a customer becasue then they lose the ability to earn the interest off of your account and make money themselves.

Don't break down.... just come here and read... that's what I do. It has helped tremendously to read other people's successes and know that I too can do this. We are all in this together in some form or another. Remember too.... this "situation" does not define YOU.... it defines an abstract moment in time! You will get through this!

Jasgal, I bank with my employer's credit union. They changed my account number - but some loans were still posting. Over the Thanksgiving Holiday I was short $500, like you. It was a nightmare. I have a few checks (legit ones) I am waiting to clear, but in the meantime I changed my account info to a new bacnk completely. My old account is active for the two checks I am waiting to clear only. But the bank members are fully aware of my situation. I am in touch with them through email almost daily. Perhaps change your bank to another location?? I think this would help with the unexpected posts. I totally understand how you are feeling.
