been tring to work with sears on a credit card everyway i know how they have a diff. story every time they call and amount i owe won't except my payments i only get disability income now have served me papers to go to court what can i do? sandy(blueridge,GA.)

They cannot garnish your disability income from social security, ssi, va you probably will have to go to cout for the hearing and just take with you the award letter or bank statement showing that all you get for income is your disability check and they probably will excuse the debt or sears might have to accept wherever you can pay them even if it is 2.00 per month.

Hello Sandy---You have done the right thing by registering on here as a member. When you register you get a free phone call from a debt counselor. A debt counselor can give you some advice about what opitions you might have. Until you get the call, feel free to post on here and ask questions. Good luck!

They cannot garnish your va, social security or ssi. You might have to go to court but all you have to do is take your bank statement and your award letter(they will probably charge off the acct) They did that to my sister.

Make sure that you show up in the court. Show the papers of your income to the judge. He will rule in your favor. If you don't show up for the hearing, you will lose your entire defense and this case might go in favor of Sears. They will convince the judge with their story in your absence and make you pay the debt at any cost. And legal actions might take place if you don't follow the court orders.
