providian debt

I live in Illinois. and had a Proviadian credit card yrs ago. It had a balance on it and I stop making payments becuae was having financial probles. they close the account and asked me to do small payments to repay my debt. The I decidded to file for bankruptcy on 2008, by then the providian was Washigton Mutual and the debt sold to a collection agency, according to the paper work I have the collection agency was notified and so far they haven't claim a dime in the bankruptcy. I got a call from some company, anthony and associates, any way, today they call telling me I was being sued for more than 5,000 dollars. It did not have that balance on it however they said due to interest and stuff it is that high. He informed me today that I was being sued and taken to court. Said they had been trying to contact me for some time now. He actually called me on my cell phone and left message what is strange is that my phone number is different now and they have all my infomation, name address SSN, etc I told them that I file for bankruptcy and that they could place a claim if they wanted, and told me that they need my attorney's name and phone number but I didn't want to give it, because I though if they bought this debt from the previous collection company this one would give them that information too, so It sounds strange to me, I can not speak to my attorney for 4 days and I worry, The bankruptcy was suppose to take care of this and also I wonder if there is not a statu of limitation on debt.


There is no need to check the SOL...the debt was included in BK and discharged. Send the collector/attorney a copy of your discharge information and inform them they are in violation of the bankrutcpy stay and to never contact you again. You really dont need to contact your attorney, not at this point.

Which state do you reside in? It would help us check the SoL. Sounds like you are getting calls from a bottomfeeder. If you are certain the debt was discharged through BK, send these people a C&D letter via CMRRR. If you are not sure about the details, you should wait for your BK attorney and talk to him.
