company couldn't validate but got judgement and I now owe 4 times as much. what can I do?


Who did file the suit against you, the CA or the original creditor? If CA failed to validate the debt and now going to sue you, please ask your lawyer to use this point in the court. It will turn the case in your favor.

Do you have the documents of your correspondence to them? You should submit copies of all these documents to the court also. Then it will be clear that they did not respond to your query.

Moreover, collection agency can only bring legal action against you if original creditor authorizes to do so. You should contact a lawyer ASAP. Keep us posted.

Stanley, sounds like doughboy may have already went to court? I thought if I collection agency couldn't validate then they couldn't sue? But maybe its the original creditor that did the sueing? Original creditor doesn't have to validate, do they? I mean if the account is YOURS, then they don't have to prove it to you right? only the CA is suppose to.

You are right Shirley. However, I'm sure some restrictions are there so that original creditor cannot impose fraudulent charges on the consumer. I think court is the best place to decide if the creditor was right or wrong. Hope Virginia-Legal-Defense will shed some light at this.

It is not clear enough whether doughboy went to court or not and who filed the lawsuit, CA or the OC? If the judgment goes against an individual, don't you think he/she can appeal to the higher court? The cost of curt cases is also to be considered here.
