Has anyone dealt with these folks and are they full of crap?

Certified Recovery Systems is hard to deal with, trust me. They can't have you arrested. There is no debtors jail. This is just a scare tactic they use everyday to get you to pay immediately. Send them a debt validation letter CMRRR and make them validate the debt before you send them anything. You have rights under the fdcpa. Please make yourself familiar with them. You can find out the FDCPA laws on the FTC website.

One thing I have learned going through this mess is like jj said above, document everything. Write down the persons name, time of call and purpose of call. It will come in handly if you have to take further actions.

One more thing to add here is about recording the phone calls of the debt collectors. 35 stats in US are allowed to record the phone calls secretly. If you are residing in one of the remaining 15 states, you will have to clearly state in the recording about the permission being taken for recording. If they continue to talk after hearing your message, permission is legally obtained for legal purpose. Later, you can present this recording to your attorney to detect the fdcpa violations.
The states that allow recording of the phone calls secretly are:
Quote:
Alabama, Alaska, Arizona, Arkansas, Colorado, District of Columbia, Georgia, Hawaii, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Rhode Island, South Carolina, Tennessee, Texas, Utah, Virginia, West Virginia, Wisconsin and Wyoming. |
Along with it, keep a log file of the date and time the calls were placed to you. The whole process will become quite handy.

Illegal to threaten
First off it is very illegal for any creditor to threaten to place you under arrest unless they intend to do so.You need to strat a log and write down every detail and report them to your Attorney General

AtlantaBoy. Welcome to the forums. You should have asked where your "case" was "going out" to?
Going out to lunch? Going out on the town? Going out and about? Going out on a date? Going out of style?
I guess you're okay as long as they don't threaten to "download" you. Still don't know what that means.
I love ominous and cryptic comments like that. Are you able to record your phone calls without them knowing? If you have the ability to record calls, I would highly recommend it. Just make sure you look at the laws regarding phone calls being recorded and your state. Also, be sure to send a DV letter and a C&D if you don't want them calling you anymore, send it CMRRR.
Also, read, read, read, this site. Make sure you understand your rights under the fdcpa and are better armed when you deal with these people.

JCEMT!
Doh! After I posted, I thought it might be "going out" on a limb, but I'm glad you cleared that up for me.
I must be getting better, I'm getting my sarcasm and cynicism back. . .in abundance.
