CRS harassing me over debt

CRS is calling here leaving messages for my mom stating that they have received a complaint against her and that if I don't relay the message she will be arrested. The lady's name was Shirley. They call once every two weeks. I thought that once a collection agency called a family memeber once, they weren't allowed to again. Shirley gave me the amount of the collection, case number and a call back number from Wallaby, Texas. Can I send them a cease & desist so they will quit calling here? My mom has stated that they call and leave a computer generated message with a number to call back, but when she calls it back all she gets is a fast busy.

CRS has done a couple of violations of the federal laws in your situation. Firstly, they are not supposed to place those calls after they have been given restricted to call you further. (Especially, if you have given the contact information of your mother)

And secondly, they should not have disclosed the account details of your mother to you.

Ask your mother to send a cease and desist letter mentioning the contacts placed to you. They must abide by the laws.

...record the call. It is absolutely against the law for them to disclose any account information to you about your mothers account. It is also against the law to make threats of actions they are not prepared or allowed by the law to take. such as arrest. If you could get anything like that on a recorded phone call, any lawyer would have a field day with that. And the best part of it is that your lawyer will have to be paid by the collection agency and shouldn't cost you a penny. collection agencies have been breaking the laws since before time. They think they can get away with it because most people have no clue what is stated in the fdcpa (Fair Debt Collection Practices Act). There are so many laws that protect the least sophisticated debtors. if you have any specific questions 'mom of twins' I would be more than happy to answer them. I've been in the industry for 6 years and am very educated in the field. And i hate when collectors break the law. Very uncool. ----

Welcome to forums.

I would like to thank you for your support. It's nice to know that there are people like you who are well-known about the rules and regulations. No doubt, the whole group is disgraced by some uneducated persons and they are larger in number.

Hope our community will get proper support from you to fight illegitimate debt collectors in future.

We need all we can get. Trust me, if it wasn't for this site, I think I would really lose my mind. I am going to be able to pay off all my debt in June..yeah! But, I just have to remind myself that I can make it until then, so this forum really does help. It reminds me I am not the only one.

RE: Recording a telephone call. Check your state laws. My state (Arkansas)says that only one party has to know the call is being recorded. So you don't have to tell them you are recording it. On the other hand some state laws require that BOTH parties know the call is being recorded - so be sure you check your state law.

Well as far as i understand even in the states that do not allow you to tape calls , all you have to do is is ask them if they will permit you to tape it, obviously before you answer any questions, that should keep them from violating anything, alot of times they will just hang up.
