This company contacted me about or on November 16, 2005 and told me I owed money for payday loans. I asked for proof and they stated they would send it but stated I had to pay or they would proceed foolishly or unfoolishly I sent $245 Western Union to them on Friday, November 18, 2005 and have received no receipt. I still owe (according to them) another $245 which they want by December 16, 2005 or they will file charges against me. Don't I have a right to a receipt before I forward more $. I do want to pay the debt but not until I have validation that there is one. I already got burnt by Ellis & Associates which I have completed the Affidavit and have spoken with the Attorney General's office in FL (the lady who is handling this account) several times. Supposedly that hearing is on December 14.

Please advise.
Thanks!

As with any collection agency, they should have provided you with a letter stating the amount that you owe. Since you did this by Western Union, you could use that as your proof. Be leary with any company asking you to send money to them via Western Union.

The next time you speak with CRSI, ask for proof that the last payment was posted. Also ask for an address stating that you wish to mail in your last payment. As a consumer, you have every right to this information.

Regards-
Mike

Thanks for the information...

There # is 713-335-1300 I do not have the full name of the company. They are out of TX and had a weird code for me to put in the account # field. I hope I was not scammed again like with Ellis & Crosby....

Please provide any information you can locate. I appreciate it so.

Should I just call them up or mail them a letter requesting information on the debt before any further payments are forwarded. I asked for confirmation of the debt before payment but she said the action would proceed if they did not receive something that week. I will NOT send any more money until I receive paperwork from them. IF I send the letter does that show confirmation. I do not want them to call my parents house or my house to harass either party any further.

Please help me with how I should proceed.

Thank you.

The number I have matches one of the ones Roxette mentioned with the TX address.

Should I mail them a letter requesting verification of the loan and my first payment and I should do this before they receive any more $$$. I believe next week I will call them if I don't have paperwork to tell them no money until I get documentation, correct.

Thanks for all of the communication.

Correct, you have to keep your basis strong. Do all your correspondence through certified mail with return receipt requested. You will have enough proof of everything.

Collector Matt, I know that Western Union/Money Gram are great ways to send money quickly but if you get no official documentation from the debt collector regarding payments and debt owed shouldn't you wait until you receive confirmation of the debt and then receive documentation of the payment?

I am not willing to pay just want to make sure that the money is going to the right place. After my dealings with Ellis Crosby & Associates, I have every right to be apprehensive.

Thanks for your comment.

I spoke with someone by the name of carmen cruz, who was very ingnorant on the phone this afternoon. I told her that i did not appreciate her calling my job and leaving a nasty message the way she did. It was not the words but the tone of her voice. Even when i called to speak with her she called me uneducated and that was not necessary and not so. I have been going through some financial difficulties for the last 2 years and i know that i am in debt to some people. This attitude does not help in getting people to try and find a way to pay their debts. I felt very uncomfortable talking to her. I asked would she like it if someone called her job and left a message like that and she just started hollering at me on the phone. She does not have people skills at all.

Hi CBUSH

Welcome to the forums.

I am sorry to hear about this. You can stop all the calls at your place of work by sending a cease and desist letter to the company's mailing address. Mention the point that you prefer to be contacted only by mail. After you have sent this letter, they are legally restricted from calling you further.

If they call you after receiving your letter, you can face up this matter in legal terms. If it is permissible in your state, please record the phone call and if it is not, take the permission from the caller that the call is being recorded for legal reasons.

It should not have been done as the way it was. File your complaints at the FTC, BBB and the state attorney general office.

Regards
Roxette

I need advice, CCS has been harassing me for a owed payment that is not even mine. CCS called my house several times leaving messages for me to contact them. At first I ignored the messages but then I called them. They state that I purchased a device from Helio and they are calling to collect. I told them that I never purchased anything from Helio and I never heard of Helio. They accused me of lying. I called Helio with the account number given to me by the collections. Helio states that they do not have me in their data base. That account belongs to some one else with my name. Nothing else matched. I called CCS to give them the information that I recieved from Helio. CCS did not want to listen. I have been going back and forth with this matter and I am not getting anywhere. I can't believe this is happening to me, I never purchased anything from Helio. CCS is trying to collect from the wrong person.

Send them a debt validation letter, be sure to include a partial cease & desist for phone calls. This forces them to prove you owe the debt. If this is not yours, they can not prove it. If they persist, if they put it on your credit, if they do anything, you can haul their sorry butts to court and collect money from -them.-

Or better yet, just send them a complete cease & desist, explain in no uncertain terms that this debt is not yours and if they continue to pursue you, you will take them to court.

Only do this is you are absolutely sure they have the wrong person, because this could force a CA to take you to court. Also keep an eye on your credit report in case they try anything tricky.

My hours were recently cut down from work. I currently owe a debt to Simms and Associates. I was given a creditor to work with named Kathleen Crane (if that is her real name). Well, I have been paying consistently each month since last year on my debt. However, since my hours were just recently cut, I explained to Kathleen that I cannot afford to pay the 175.00 each month now. I can only pay $50.00 month. When I told her that she informed me that they will not accept this amount. She told me that if I did not get a $100.00 payment by Thursday, August 28th then she would process this so that I would be sued and they would send someone to my home to auction off my things in my apartment, also she said that she was going to have them put a lien on my apartment and car and take 45% of my income in order to get the debt. Then she messed up with her days. After all that, she then told me to get it into her office by Friday, but she said that she would not be there. When I asked her what am I to do about $100.00 she yelled at me and said "BORROW IT." I was very upset. So I decided to borrow the money, but I could only borro $50.00 from a sick relative. When I called her back, I explained to her that I did not appreciate how disrespectful she was towards me and that I wanted a document faxed to me stating the measures that this company was going to take if she did not receive the payment by the next day or the same day, and to inform her that I am sending the $50.00 today. Well, after I told her to fax that document to me she became very angry with me and she hung up on me. I never even got a chance to tell her that I am sending the payment. I paid the $50.00 anyway.

It appears to me that CRSI is engaged in a variety of illegal practices with regards to collection efforts. Not only do they harass people in their work place, they also use caller id hacking software to make it appear that their call is coming from someone you know. They also tap into company databases to find out who your manager is, and send information about their complaint to them, as well. This company doesn't just have bad people skills, they are BAD PEOPLE and need to be sued for their illegal practices.

What is amazing to me is the amount of laws that these "debt collectors" break on a daily basis. You really, really need to read the Fair Debt Collections Practices Act. They can not threaten you and are required to provide the validation of the debt if asked. NEVER NEVER EVER agree that you owe a debt. You ALWAYS ask them to prove it!!! It is the Law and it is your RIGHT to demand the validation of a debt. Tell them you will no longer take phone calls and that the must cease and dessist all communications with you. Bet you did not know that you could do that! Under the FDCPA you can tell them to stop calling you, if they do after you have given them notice, they are breaking the law and you can take them to small claims court and SUE THEM! Don't let them scare you with threats about showing up to your house and auctioning off your stuff. Look, I am an expert with dealling with these guys and have had multiple judgments vacated and have shown multiple people how to win against these "Criminal's!" PLEASE EDUCATE YOUR SELF...READ THE FDCPA. feel free to contact me at Bye the way...never contact a lawyer about this stuff...all they want is your money/billable hours.

Email address removed per the TOS, Shazzers
