Both of us work, but there never seems to be enought at the end of the day. Somethings get paid and others do not and creditors are calling and harrasing us. At this point I am scared and feel as though we are drowing in debt. I try to get help and no one wants to help and have no where to turn. Please can someone give us any suggestions.

Hi tcolwell

Welcome to the forums. Creditors are not allowed to harass the consumers as per the fdcpa law and if they are doing so, you need to make them aware of your consumer rights. It seems that you are willing to pay the debt but a proper payment plan from both ends will help you in solving this problem.

I will suggest you to write a letter to your creditors to stop contacting you and formally under Section 805 [15 USC 1692c] of the Fair Debt Collection Practices Act, they are not allowed to communicate further unless:

  • It is to advise that your collection efforts have been terminated
  • To notify of any specified remedies
  • To notify that they have invoked a specified remedy

Please note that any failure on your behalf to comply with the laws of the Fair Credit Reporting Act and the Fair Debt Collection Practices Act will result in legal action.

Also, the counseling will be of great help to you that will open up some easy options to your debt repayments. Please do not feel sad about it. Let the consultant handle it proficiently and offer you easy monthly payment plans as per your present financial situation. You will soon be able to overcome all the problems.
