asset acceptance is sent me a 'dun' offering 70% discount of a debt of $428.00 that among others that was discharged in U.S. bankruptcy court over 13 years ago. I believe they are in violation of federal law because if I pay $128.00 they are demanding it will certainly not do anything positive for my credit rating and I think it is against federal law to try and collect a debt that has been discharged. This is called harrassment. The amount originally owed was to Diner's Club. I had to file for bankruptcy during nasty divorce proceedings.

Not only this debt was discharged during bankruptcy, but also it is past the SOL period as well as the 7 years reporting period.

It is also clearly understood that this debt will put no effect to your credit ratings and your scores won't increase if you make payments. Be firm on what you have decided.

You should send a C&D letter to the collection agency to stop all the collection calls coming at your end. Once they have received your letter, they are required to stop contacting you. If they do, it will be a violation of the fdcpa law and you are in charge of taking legal actions against them. Send your letter through certified mail with return receipt requested. This will help you to track down the date on which they received your letter.

Consult your attorney if it goes that far.
