mom's debt after her death

my mother died in september 2004. she had not paid bills including credit cards for a few months prior to her death, can i be held liable for her debts?


Bykergirl, I am sorry to hear the sad news about your mother. If the credit card company contacts you, tell them that you have not signed anything jointly with her, so you won't be held responsible for her debts.

But, if your mother has co-signed with you in the contract, then the credit company will try to collect the money from you as per the agreement.

I believe your mother's estate is liable for her debts. For example if she had a life insurance policy for $10,000 and debts of $3,000. Then you, provided you are the sole benificary, would receive $7000. But they can't come after you directly, unless you are a co-signer.

Of course your best bet is always to consult an attorney as they are familiar with your local and state laws.
